The OP files hazira through its lawyer. The complainants have not taken any step today on repeated calls. The complainants are found absent. None appears on behalf of the parties. Today is the date fixed for fixing for filing WNA by the complainants and also for hearing of the case. It appears from the previous orders dtd. 28.05.2014 and 30.05.2014 that the complainants did not file WNA inspite of getting series of opportunities, but the OP filed WNA on 28.05.2014. The complainants took several dates for time on the ground of compromise.

It has already been mentioned that the complainants even today did not take any step and found absent on repeated calls. It reveals from the WNA filed on 28.05.2014 by the OPs that the Zonal Manager, Midnapore Zone issued an order being no. 331 dtd. 30.04.2014 sanctioning Rs.250000 for payment of exgratia/solatium in favour of the legal heirs of the deceased Suratjan Bibi as per order and clarification of WBSEDCL. The complainants took several times for filing WNA and hearing on the ground of compromise. The above circumstances suggest that the complainants are not willing to proceed further with case for reason stated above.

In the above circumstances, we feel that this case should be dismissed for non- prosecution/defaults.

Hence, it is ordered, that the instant case be and the same is dismissed for non- prosecution/defaults without any cost.
