         On the other hand the learned counsel for the opposite party bank argued that as per the terms and conditions of loan agreement bank has general lien on all the securities deposited by the customers with the banks and banker’s lien gives the bank a right to transfer to what ever account the bank chooses to set-off or to liquidity the debt and in this case since the complainants fail to repay the loan of Rs.17,000/- the F.D.R. amount was adjusted to the loan amount and there is no deficiency in service on the part of the opposite party.
