ORDER

Present:       Complainant with Shri Rampal Singh, Adv. for the complainant.

                    Shri Parmod Gupta, Adv. for the respondents.

                                                                            

                On the basis of even dated application filed by the parties, file taken up on today. Parties have entered into compromise. Counsel for the respondents suffered statement consenting to compensate the complainant in the sum of Rs.96,500/- within the period of one month from today. Statement of complainant represented by his lawyer to this effect is also recorded separately.

                   In view of the statement of counsel for the respondents and the complainant, as the matter has amicably been settled between the parties, therefore, without making any adverse comment against the respondents, the complaint is, partly, accepted against the respondents and they are held liable to make the payment of Rs.96,500/- (Rupees ninety six thousand five hundred only) to the complainant, within the period of one month from today, in default of it, amount of Rs.96,500/- shall carry on interest @7% per annum (simple) from the date of order, till actual realization. Apart from it, provisions of Section 25/27 of Consumer Protection Act, 1986 may be invoked against the respondent No.1 to enforce this order. It shall be the primarily liability of respondent No.1 to do the compliance of this order, being the local branch of The Star Health and Allied Insurance Company Ltd. File be consigned to records.
