The complainant has filed this instant petition of complaint with a prayer for direction upon the OPs to give electric connection to the house of the complainant as the complainant had furnished all the formalities as per requirement of the OPs, but the OPs did not take any steps to give electric connection to the house of the complainant. Hence the case,

          The OPs gave quotation to the complainant after inspection of the spot. The complainant accordingly deposited security money and other charges for the service connection on 7/11/2014. The O.Ps reportedly went to the spot but did not give electric connection to the complainant. The complainant pursed the matter and requested the OPs several times to give the electric connection, but the OPs did not pay any heed to his prayer. The complainant being harassed further sent a written letter to the OPs bur till the OPs did not take any steps.   

          The OPs contested the instant case by filing separate written version where in all the material allegations made against them by the complainant have been denied. The OPs argued that they went to the spot to give electric connection to the house of the complainant but the neighbours of the complainant put strong resistance to give said electric connection over alleged land dispute.

Points for Consideration

  1. Whether the complainant is entitled to any relief as sought for?
  2. Whether there is any deficiency in service on the part of the OPs?

Decision with reason

Both the parties filed their respective documents as per their respective list of documents.

We have heard the Ld. Advocates of both sides over the argument and carefully gone through the pleadings and documents on record filed by the parties.

Both the points are taken up together for brevity of discussions.

Ongoing through the records, we find that the complainant applied for a new electric service connection at his premises to the OPs and the OPs, after inspection of the spot, issued the quotation. As per the quotation, the complainant deposited the security money and service connection charge duly to the OPs. But the O.Ps did not give the said electrical connection at the premises of the complainant. The complainant, being B.P.L. card holder, made all attempts to pursue the O.Ps to execute his work, but the O.Ps did not take any steps for which the complainant has been suffering a lot. According to the O.Ps, they could not effect the electric service connection to the house of the complainant due to strong resistance caused by neighbours of the complainant over some land dispute. Had it been so, the O.Ps could have taken the help of local Police Station in order to execute the work of effecting the electric connection to the house of the complainant. But they had not taken any such step.

In view of the above act of the OPs and considering the materials on record, we feel that there is deficiency in service on the part of the OPs in relation to effecting the electric service connection to the house of the complainant, since electricity being an essential commodity should reach every consumer who seeks service connection on payment of requisite fees. 

Therefore, in our considered view, the complainant is entitled to relief as sought for. Both the points are, thus, disposed of in favuor of the complainant.

Hence, it is,

O R D E R E D

That the consumer case being No.CC/23/2015 be and the same is allowed on contest against the O.Ps. The OPs are directed to give/effect electric service connection in residence of the Complainant as mentioned in the petition of complainant, with Police  help from Local Police Station, if necessary, along with litigation cost of Rs. 2000/-to the Complainant within 30 days from the date of communication of the order, failing which the Complainant will be at liberty to execute the order as per Law, in which case the OPs shall pay fine @Rs. 200/- per day to the Complainant  till compliance of the order in toto.
