Today is fixed for hearing of compromise petition dated 20.06.2022 filed by the complainant and the O.P. Nos.3 & 4 and the O.P. Nos.1 & 2 were directed to take initiative in the matter, if they so desire.

The complainant files hazira through the Ld. Advocate. O.P. Nos.3 & 4 also files hazira through the Ld. Advocate.

The compromise petition dated 20.06.2022 filed by the complainant and the O.P. Nos.3 & 4 is taken-up for hearing and order. Heard Ld. Advocate of both sides.  O.P. Nos.1 & 2 did not take any step for initiation in the matter at all and none appeared on behalf of them on repeated calls.

Perused the case record and the compromise petition dated 20.06.2022 it appears that the case has been amicably been settled in between the complainant and the O.P. Nos.3 & 4 i.e., among the legal heirs of the deceased Jharna Hazra, W/O- Laxman Chandra Hazra by the intervention of some local well wishers in respect of share of the deposited money on condition that each of the complainant and the O.P. Nos.3 & 4 will get equal 1/3rd share.

The said money was deposited on 25.01.2018 in a monthly income scheme to the O.P. No.2 i.e., Burdwan Head Post Office by the Account No. 3906232926 by a sum of Rs.4,16,000/- (Four Lakh Sixteen Thousand) only as principal amount and the amount of monthly interest of money in another S.B. Account being No.1737953461 and CIF No.134476379 to the O.P. No.2  and some other money in another monthly income scheme being No.1738571480 to the O.P. No.2 described in the schedule appended to this compromise petition and upon this background, complainant is not willing to proceed with the case further and prayed for dispose of the matter on the ground of this compromise. This compromise appears to be legal, valid and proper. Hence it is

Ordered

that this case be and the same is disposed of in terms of compromise. The compromise petition do form part of this order.

Let a copy of this order be given to the parties on free of cost.
