F I N A L O R D E R
1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.ps. to disburse the maturity value of the four NSCs purchased on 24.03.2006 for Rs. 10,000/- each and to pay compensation to the tune of Rs. 45,000/- together with litigation costs as the o.p. in spite of repeated requests turned deaf ear.
2. The o.ps. in their written version stated that for regularization as per departmental procedure there was delay in disbursement.
3. Upon pleadings of both parties two points arose for determination :
i) Is there any deficiency in service on the part of the O.Ps. ?
ii) Whether the complainant is entitled to get any relief as prayed for ?
DECISION WITH REASONS :
4.Both the points are taken up together for consideration. Admittedly the complainant purchased 4 NSCs being no. 6NS/79EE 776221, 6NS/79EE 776222, 6NS/79EE 776223, 6NS/79EE 776224 on 24.3.2006 for Rs. 10,000/- each which got matured on 24.3.2012. On repeated requests those could not be disbursed. The plea as put forward by the o.p. is not at all acceptable. On scrutiny of the enclosures, we are of the view that this is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of.
Hence,
O R D E R E D
That the C. C. Case No. 203 of 2014 ( HDF 203 of 2014 ) be and the same is allowed on contest with costs as against the O.Ps.
The O.P. be directed to disburse the maturity value of the four NSCs as mentioned above being total of Rs. 64,040/- together with interest at the rate of 7 per cent per annum since 24.3.2012 till full satisfaction within 30 days from the date of this order.
The o.p. be further directed to pay Rs. 2,000/- as litigation cost to the complainant.
No order as to compensation.
The complainant is at liberty to put the decree into execution after expiry of the appeal period.
Supply the copies of the order to the parties, as per rule.
