The case is posted today for hearing on admission. Heard the matter from the side of Complainant and also perused the case record and found that the Complainant belongs to Thalsada under PS and Dist: Balasore and at present also residing at Dungura in the District of Balasore. She has also made parties to O.Ps 1 and 2 who belong to Balasore District and they also carry on business within the jurisdiction of Balasore District. She has filed a petition u/s.11(2)(b) of the C.P. Act seeking permission to file the case at District Forum, Bhadrak mentioning the reasoning at para-5 of her petition that Bhadrak District Forum is nearer than Balasore District Forum. Previously Bhadrak and Balasore was one District and at present Balasore District is also a neighbor District of Bhadrak. As the cause of action for filing the case and the business transaction carried on by O.Ps coming under the jurisdiction of Balasore, the Complainant is directed to file the case before the District Forum, Balalsore for ends of justice. Accordingly, the C.D. Case filed by the Complainant is disposed of on hearing on admission stage.
