U.K. Tyagi, Member ORDER Member: Ms. Kiran Kaushal - Briefly put, the Complainant, Ms. Dimple Tiwari deposited sum of Rs.35,000/- each on 10.06.2015 in Sukanya Samridhi Yojna (SSY) accounts of her two daughters. SSY account no. 2505103774 and 2505103781 were opened in the name of Ananya Singh Tiwari and Anvita Singh Tiwari respectively. The said accounts were opened at the SPM, Kidwai Nagar East Post Office, New Delhi- 110023, hereinafter referred to as OP-1.
- Complainant after few months, checked the accounts with OP-1 to deposit the amount further and found that the entry of Rs.35,000/- deposited by her, in both the accounts was missing. Worried and shocked the Complainant lodged complaints to PO on 13.02.2016, to Chief Post Master General, Delhi on 30.03.2016 and to Deputy Director General (FS) Dak Bhawan, Delhi on 06.08.2016. It was on 18.08.2016 that the complainant heaved a sigh of relief as she received a mail from the office of Sr. Supdt of Post Offices, acknowledging the amount deposited by the Complainant in the account of her daughters vide Cheque Nos. 245648 and 245649 of HDFC Bank amounting to Rs.35,000/- each. The said mail reveals that the Cheques were received at Sarojini Nagar HPO on 08.06.2015 and were cleared on 10.06.2015, however even after clearance of the Cheques no fund/amount was credited into the respective SSY accounts in the system.
Thus, aggrieved Complainant approached this commission with prayers to direct OP to credit Rs 35,000/- along with interest, in each of the SSY account of her daughters. It is also prayed that OP be directed to pay Rs.5,00,000/- on account of mental agony and litigation cost. - Per contra, the plea taken by OP is that, as and when the complaint was filed by the Complainant, OP took action on the same. OP received the complaint on 16.02.2016, which was enquired by IPO then sent to Chief Supervisor, CPC CBS, thereafter it was raised before Asst. Director(PG) CPMG, Delhi circle. The matter was again referred to CPC CBS and subsequently on 06.08.2016 the SPM received letter dated 18.08.2016 from Senior Superintendent of Post Offices directing them that:
As per instruction received from CPC- CBS, Delhi circle, this amount may be credited in the respective SSA account with value date at SO level and the interest of this amount is to be calculated manually upto 31.03.2016 and added in U/R SSA accounts at HO level. - It is further submitted that entries for Rs.35,000/- have been made in both the SSY accounts. It is thus prayed that the complaint be dismissed
- Rejoinder is filed by the Complainant. Evidence by way of affidavit is filed on behalf of the parties. Written submission on behalf of OP is filed. Arguments on behalf of parties are heard. Material placed on record is perused.
- Admittedly, the amount of Rs.35,000/- in the two SSY account of the daughters of the Complainant, though deposited was not credited in their accounts. The principle amount was credited in both the accounts after two years and nine months. That too after lodging complaints to the Post Master, Chief Post Master General, Delhi and Deputy Director General (FS) Dak
Bhawan. Thereafter, despite the directions received from CPC-CBS, Delhi circle vide letter dated 18.08.2016 issued by Senior Superintendent of Post Offices the money with interest was credited in both the accounts on March, 2018 - Sukanya Samridhi Accounts is a Government of India backed saving scheme, which encourages parents to build a fund for the future education and marriage expenses for their female child. The lackadaisical approach of OPs show the sorry state of affairs and it is because of this approach that common man tends to loose faith in the system and the welfare schemes run by the Government. We are of the considered view that Ops were grossly deficient in providing service to the Complainant .OP is deficient not only on account of not crediting Rs.35,000/- in each of SSY accounts but also OPs did not think it appropriate to revert back or inform the Complainant that they are in receipt of the money deposited by the Complainant. Complainant had to lodge various complaints for rectification of the accounts before her grievance was redressed.
- In view of the facts and circumstances discussed above we hold OPs guilty of deficiency in service and direct OPs to deposit Rs.10,000/- each in the accounts of Ananya Singh Tiwari, account no. 2505103774 and Anvita Singh Tiwari, account no.2505103781 within three months from today.
Additionaly, OPs are directed to pay Rs 10,000/- to the complainant towards harassment and mental agony. If the said amount is not deposited within three months, OPs shall pay interest @8% from the date of filing of the complainant till realization.
