This complaint is filed by the Complainant u/S 12 of the Consumer Protection Act, 1986 alleging deficiency in service as well as unfair trade practice against the OPs.

During admission hearing of this complaint it is seen by us that this complaint was filed on 04.12.2017 and the date was fixed for admission hearing on 14.12.2017. On the said the Complainant prayed for an adjournment. Next date was fixed for admission hearing on 02.01.2018 and on that date also the Complainant took time and the Complainant was directed on 02.01.2018 for filing the cogent document for which the present dispute cropped up. On 11.10.2018 during hearing on its admissibility we have noticed that the Complainant did not file the required document and submitted that the Tag no showing the weight of the questioned luggage is not available with him. It is seen by us that the present dispute revolves within a very short compass i.e. the luggage of the Complainant had been lost/misplaced and he came to know the same after reaching at Mumbai Airport. Be it mentioned that was travelling from Kolkata to Mumbai in the Spice Jet Airlines on 25.03.2017. As the said luggage could not be traced out by the Airport Authority till filing of this complaint, hence having no alternative this complaint is filed by the Complainant praying for compensation from the OPs due to loss of his luggage. In this connection in our view the weight of the said luggage is very much relevant and depend on the weight of the luggage compensation amount can be ascertained. But the Complainant has submitted the luggage Tag showing its number and weight is not available. Therefore as the Complainant is unable to file the said cogent document, we are not in a position to admit the complaint.

Hence it is ordered that the Consumer Complaint being no-603/2017 is hereby dismissed without being admitted. However the Complainant is at liberty to approach the appropriate authority seeking his relief, if not barred otherwise. 

Let plain copy of this order be given to the parties free of cost as per the provision of the CPR, 2005.
