ORDER

Heard the counsel for the complainant on admission. The complainant has filed this complaint for a direction to the opposite party to execute the title deed in pursuance of lease cum sale agreement executed by the opposite party. It is found that the opposite party through their letter dated 22.04.2009 informed the counsel for the complainant that what ever amount due by the complainant has been paid and the complainant was told to arrange for registration fee and stamp fee for getting the sale deed executed but has not turned up and counsel for the complainant was informed to inform the complainant accordingly to get the deed executed. But, it appears that complainant has not responded to the notice dated 22.04.2009. The counsel for the complainant is asked to point out any response given by the complainant to the letter of the opposite party, but failed to show the response. It emerges that the opposite party never refuse to execute title deed in pursuance of the sale agreement when there is no refusal by the opposite party, we find no cause of action for this complainant. Thus, complainant may approach the opposite party for getting the sale deed executed at this cost and only in the event of opposite party failing to execute the title deed, then the complainant may approach this Forum. Hence, complaint is dismissed at the stage of admission.
