  1. In the instant case the Complainant has sought for following reliefs against the Opposite party:-
  1. To direct the opposite parties to serve the energy bill for month of July 2012, Aug 2012, Sep 2012, Oct 2012, Nov 2012, Dec 2012, Jan 2013 to the complainant.
  2. To direct the opposite parties to make correction in the energy bill for month of Feb 2013 and march 2013 and Sep 2014 after deduction the amount of Rs. 2,606/- paid in the month of July 2012.
  3. To direct the opposite parties to pay Rs. 10,000/- ( Rs. Ten thousand only ) as compensation.
  4. To direct the opposite party to pay Rs. 5,000/- (Rs. Five Thousand only ) as litigation costs.
  1. The facts of this case lies in a narrow compass which is as follows:-

The complainant has asserted that he is having a electric connection in his residential house situated at Village – Tarwan, P.O. – Pawera, P.S. – Dhanarua, District – Patna having consumer account no. 2617520. The complainant’s meter was accessible and the same was inspected by concerning staff of electricity department and nothing illegal was found. The complainant paid electric bill regularly and the same was paid upto July 2012 as will appear from annexure – 1.

The complainant has further asserted that when energy bill was not supplied regularly then he approached opposite party no. 2 several times for issuing electric bill in order to avoid future complications.

After visiting the office of opposite party no. 2 the energy bill for the month of Feb 2013 and march 2013 was served to the complainant in which it was stated that the total energy charge including energy dues is 3,686.43/- as will appear from annexure – 2.

Thereafter the complainant approached the office of opposite party no. 2 and filed an application dated 24.04.2013 requesting him to make correction in energy bill of Feb 2013 and March 2013 but no order has been passed on the said application. Then the energy bill for the month of Sep 2014 was issued and provided to the complainant in which it is stated that the entire energy charge is Rs. 5,630/- but the details of last payment was not mentioned in the bill and the same was not deducted from the entire bill.

The complainant thereafter filed an application before S.D.O. Masaurhi (opposite party no. 3) but no order has been passed.

It appears from the record that the copy of this complaint was served on the counsel of the department but no written statement appears to have been filed.

The main grievance of the complainant is that the energy bill from the month of July 2012 upto Jan 2013 has not been served on the complainant and despite payment of Rs. 2,606/- in the month of July 2012 in subsequent bill this amount was not adjusted.

After hearing the learned counsel for the complainant and perused the complaint petition we make following direction to the parties.

The complainant is directed to file a detail representation stating all the facts with the copy of this order to opposite party no. 2 i.e. electrical executive engineer, electric supply Division, Masaurhi, Patna within the period of one month from the date of receipt of this order or certified copy of this order.

If the aforesaid application is filed by complainant, the opposite party no. 2 is directed to pass reasoned order on the aforesaid application in accordance with the law within the period of two months from the date of filing of application by the complainant.

The opposite party no. 2 after receiving the aforesaid application by the complainant must serve the bill of July 2012, Aug 2012, Sep 2012, Oct 2012, Nov 2012, Dec 2012 and Jan 2013 to the complainant after adjusting the previous payment by the complainant if any.

This case is stands disposed off in the light of aforesaid direction.
