Final Order / Judgement

PRESENT

Complainant in person along with Adv.Shri.S.H.Patil Present.

                                   ORDER

(Per- Shri. S.D. MADAKE, Hon’ble President )

1. The complainant has taken insurance policy of shriram General Insurance Company vide policy No. 215064/31/00/1331 during 25.8.2017 to 26.8.2018.

2. According to complainant , the said policy was in respect of his car bearing No.MH-071 AD 17861. The said car was purchased by obtaining loan from Sarasvat Bank.

3. According to complaint, the insured car met with an accident during insurance period i.e. on 21.11.2017. He sustained injuries and his family members also sustained injuries.

4. According to complainant, he submitted claim to opponent. Which came to be rejected without valid reasons on 23.12.2017.

5. The complainant claimed Rs.15,00,000/- towards rejection of claim as well as mental agony and cost.

6. The complaint was admitted on 8.5.2018 . The opponent appeared and filed written version on 12.09.2018 and resisted allegation made in the complaint.

7. The main contention raised was that complainant made false declaration that he had not made any claim with SBI General Insurance and and availed 50 % discount in premium.

8. According to opp. surveyor assessed loss to the amount of Rs.9,68,586/- but due to wrong declaration opp. rightfully repudiated the claim.

9. The opp. prayed for dismissal of complaint with cost.

10. We have perused all documents. On 8.10.2018 both parties filed joint pursis by taking the matter on board as the next date was given 7.2.2019.

11. We have perused the contents of joint pursis where both parties amicably settled the claim. The opp. paid Rs.6,50,000/- as full and final settlement.

12. We found that the terms of compromise as reasonable , we accept the same and proceed to pass order.

                                    ORDER

1. In view of the joint-pursis Consumer complaint No. 195/2018 is disposed of with no order as to cost.

2. Copy of this order be sent to both parties.
