ORDER.

The present dispute arises out of the complaint petition filed by the above named complainant  alleging deficiency in service  against the afore said O.Ps for non  replacement of Battery within the warranty period. The brief facts of the case is briefly  summarised  hereunder.                                                          

Sri Sri I.M.Panigrahi, learned counsel for the  O.P. No. 1 appeared before the forum on  behalf of the O.P No.1   &   vehemently advanced arguments.

            Sri  S.K.Sahu, learned counsel for the  O.P. No. 2 appeared before the forum on  behalf of the O.P  No.2   filed written version  &   vehemently advanced arguments.

            The learned counsel for the  complainant appeared  in person before the forum  and  filed a memo stating that  the complainant  has received a Battery (New) from the O.P. No.1 as such  the complainant wants to with draw the case and does not wants to proceed further in the present case.  Hence considering  the memo of the complainant praying not to continue further proceeding  of the case before the forum. The memo is allowed.  Accordingly the case is closed.
