COM. NO: 1571/2008 31/07/2008 Complainant/By Sri:- KRR Opposite Party/By Sri:- Perused the complaint. As per the allegations made in the complaint the husband of the complainant died on 10th day of February-1980. His LIC policy claim was settled by the opposite party on 5/9/1980. Now the complainant who is the wife of the deceased has filed this complaint stating that the opposite party has not given double accidental benefit claim. Therefore, she wants that the opposite party be directed to pay double benefit of the policy amount due to accidental death of Police Constable. As per the own allegations and admitted facts this is a matter of 1980. The complainant has approached the Forum after more than 27 years. This complaint is barred by time. U/Sec.24 (A) of the Consumer Protection Act, 1986 the District Forum shall not admit a complaint unless it is filed within 2 years from the date on which the cause of action has arisen. In this case admittedly the LIC claim was settled by the LIC of India in the year 1980 itself. If at all there was any dispute the complainant could have filed her complaint or filed Civil Suit before the Civil Court within the period of limitation. The complainant having slept over on her rights for more than 25 years and now she has come with this complaint same is not maintainable. The complaint cannot be admitted in law since it is barred by time. No reasons are given for such inordinate delay in filing complaint. Therefore, the complaint deserves to be dismissed at the admission stage itself. In the result, I proceed to pass the following:- ORDER The complaint is dismissed. No order as to costs.
