The decree-holder (complainant) filed the case against the judgement debtors (OPs) with the allegation of negation of the claim of the decree-holder and earlier case was filed being CC No.63/2012 and the decree-holder got an order in her favour whereby the Forum was pleased to pass an order and directing judgement debtors 1 & 2 to pay to the decree-holder sum assured of Rs.2,50,000/- plus interest @ 8% p.a. from the date of filing of the claim of the decree-holder.
Against the said order the judgement debtors preferred an appeal before Hon’ble State Commission and the State Commission upheld the order by modifying the other parts of the order affirming the substantive portion of the order that the judgement debtors must pay an amount of Rs.2,50,000/- along with interest @ 8% p.a.
Judgement debtors subsequently in compliance with the order passed by the Hon’ble State Commission paid claim amount as well as interest i.e. the judgement debtors paid Rs.2,95,885/- and the judgement debtors have claimed that they have paid excess amount. In spite of receiving the said amount the decree-holder has come before this Forum praying for further amount due on account of interest from the judgement debtors.
Heard Ld. Advocate on record as well as seen the statement of the LIC of India (judgement debtors) wherefrom it appears that the LIC of India has paid the entire amount along with interest in compliance with the order passed by the Hon’ble State Commission, West Bengal.
In view of the facts and circumstances of the case I do not find that judgement debtors will be further liable to pay any amount to the decree-holder, the claim made by the decree-holder false, frivolous and vexatious one. Accordingly, the petition filed by the decree-holder and the Execution Application is disposed of with full satisfaction.
