Final Order / Judgement

                                         The case is posted today for hearing of the petition Dtd. 28.02.24 filed by O.P No.1 & main hearing. Advocate for the complainant is absent, no steps filed. Advocate for the O.P No.1 is present & files hazira. O.P No.4 is absent. On repeated calls, none respond on behalf of the complainant. Hence, hearing of the case could not be taken up. Perused the case record.

                                         In the present case, the O.P No.1 was appeared & filed w/v and the case against O.Ps No.2 & 3 was dismissed earlier on 28.02.24. As it appears from the case record that the complainant remained absent since 13.12.21 to till today except 21.08.23 & 25.09.23, for which hearing of the case impaired and the valuable time of this Commission is being wasted. Considering the nature & conduct of the complainant and petition Dtd. 28.02.24 filed by O.P No.1, this Commission is of the view that the complaint of the complainant should be dismissed.   

                                         Accordingly, the complaint of the complainant is dismissed for non-prosecution of the case. The interim order, if any, passed against the O.Ps is treated to be infructuous.
