The case of the Complainant in a nutshell is that complainant Sri Pradip Ch. Paul purchased 2 (two)  certificates ( Golden VM & super BB) from OP.No.1  the  description of   which has been given in the complaint . The Golden VM certificate was matured on 18.05.2019 but super BB certificate could be redeemed after expiry of 36 months from the date of joining( i.e after 30.12.2020). Subsequently on maturity of the Golden VM certificate and after expiry of 36 months from the date of joining of supper BB certificate, he approached the O.P.1 for payment of maturity  and redemption amount but OP1 failed to make payment of the same. Even a written complaint filed by the complainant on 09.02.2021 did not receive any positive response from OP No.1 and finally he was compelled to file this instant case on 03.03.21 praying for reliefs. It is evident from the case record that both OPs received the summons from the Ld. Commission but did not appear before the Commission to contest the case . so the case was heard exparte. On the other hand complainant contested the case by filing evidence on affidavit and written argument. He prayed to pass an order to direct the OPs to pay him the amount of maturity which is Rs.116868 with up to date interest, Rs.100000/- for deficiency in service and mental pain and agony and Rs.20000/- for litigation cost.

POINTS FOR CONSIDERATION

  1. Is the instant case maintainable?
  2. Is  the Complainant entitled to get any relief .
  3. To what other relief if any he is entitled?

DECISION WITH REASONS

All points are taken up together, for convenience of discussion. Complainant purchased two(2) certificates ( Golden VM & super BB) from OP.No.1 with amount of Rs.21500/- and Rs.32000/- which were matured on 18.05.19 and 30.12.20 respectively as mentioned  in the complaint petition. But there is no maturity date and maturity value in the certificate of super BB. Neither the Ld. Counsel of the complainant gave clarification regarding the maturity value of super BB during argument nor there was any maturity value printed on the certificate itself but it could be redeemed after expiry of 36 months. Despite repeated request and even written complaint lodged with OP No.1 yielded no result in favour of the complainant with respect to the payment of maturity and redemption amount. Here, on maturity he claimed the matured amount from the OPS but he was denied of the same by them. So there is deficiency in service on the part of the OPs and complainant was harassed by the OPS which caused mental pain and agony. Therefore the complainant is entitled to the relief as prayed for. With this all the issues are disposed of.    

Hence, it is

Ordered

That  the instant case be and the same is allowed ex-parte. 

The O.Ps are hereby directed to pay the amount of maturity Rs.33,024/- for Golden VM certificate with interest @ 6% PA from the date of maturity till realization. The O.Ps are also directed to pay Rs.32,000/- for super BB certificate with an interest @ 8.5% P.A from the date of deposition of the amount till realization of the amount.

This apart, O.Ps are also directed to pay Rs.5,000/- for deficiency in service and mental pain and agony and Rs.2,000/- for litigation cost. 

Let plain copy of this order be supplied to the parties concerned by hand/by post forthwith, free of cost for information and necessary action, if any.
