The case of the Complainant in a nutshell is that Complainant, Mr. Mrinal Kanti Roy purchased two(2) certificate of Sahara India Credit Co-operative society Ltd.( Golden 24) from O.P. No.1, the description of which has been given in the Complaint petition. The said certificates were matured on 30.06.2020. Subsequently on maturity he approached the O.P. No.1 for payment of maturity amount but O.P. No.1 failed to make payment of the same. Even a written complaint filed by Complainant on 31.08.2021 did not receive any positive response from O.P. No.1 and finally he was compelled to file this instant case on 16.09.2021 praying for reliefs. It is evident from the case record that both O.Ps received the summons from the Ld. Commission but did not appear before the Commission to contest the case. So the case was heard exparte. On the other hand Complainant contested the case by filing evidence on affidavit and written argument. He prayed to pass an order to direct the O.Ps to pay him the amount of maturity which is Rs.33,493/- with up to date interest, Rs.20,000/- for metal pain and agony and Rs.10,000/- for litigation cost.

- Is the instant case maintainable?
- Is the Complainant entitled to get any relief?
- To what other relief if any he is entitled?
DECISION WITH REASONS
All the points are taken up together for Convenience of discussion . Complainant purchased (2) two certificates (Golden 24) from O.P. No.1 with amount of Rs.13,300/- and Rs.13,400/- which were matured on 30.06.2020. Despite repeated request and even written complaint lodged with O.P. No.1 yielded no result in favour of the Complainant with respect to the payment of maturity amount. Here, on maturity he claimed the matured amount from the O.Ps but he was denied of the same. So there is deficiency in service on the part of the O.Ps which in turn causes mental pain and agony to the Complainant.
Therefore the complainant is entitled to the relief as prayed for. With this all the issues are disposed of.

Ordered
That the instant case be and the same is allowed ex-parte.
The O.Ps are directed to pay the amount of maturity Rs.33,493/- with interest @ 6% PA from the date of maturity till realization.
This apart, O.Ps are also directed to pay Rs.5,000/- for mental pain and agony and Rs.2,000/- for litigation cost.
Let plain copy of this order be supplied to the parties concerned by hand/by post forthwith, free of cost for information and necessary action, if any.
