                                                          JUDGMENT

JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

 

          The appellant is the complainant in CC 88/09 in the file of CDRF, Pathanamthitta.  The complaint has been dismissed on the ground that the complainant has not produced the impugned bill involved in the matter.

          2. The evidence adduced consisted of the proof affidavits of the respective    sides and    Ext.B1 and B2.

          3. On  a perusal of the Judgment, we find that the Forum has dismissed the complaint  on very flimsy ground.  The Forum is not expected to remain passive.  It is also pertinent to note that the opposite parties have not disputed the details mentioned with respect to the bill.  The Forum ought to have directed the complainant or the opposite parties to produce the bill or copy of the same.

          4. In the circumstances, the order of the Forum is set aside.  The Forum is directed to dispose of the matter on merits.  The Forum will issue notice to the opposite parties.

          5. The case stands posted before the Forum below on 27.8.06

          The office will forward the copy of this order to the Forum urgently.
