ORDER

By R. VIJAYAKUMAR, MEMBER. The Complaint is filed for getting one order directing opposite parties not to disconnect the electrical connection to Consumer No. 2022 , to issue bills in the name of the Complainant and for compensation and cost. The avernments in the Complaint can be briefly summarized as follows: The electrical connection with No. 2022 was issued to the residential house during of the Complainant as per agreement executed between the Complainant’s father and KSEB. The residential building which originally belongs to Complainant’s mother Meenakshi but as per partitioned executed in the year 1983 it was allotted to the Complainant. After the death of Complainant’s father in the year 1992 electrical connection was in the name of Complainant and is paying electric charges promptly and regularly. Opp.parties issued invoice book in the name of Complainant and he is paying electrical bills as per the invoice. The Complainant and other two brothers of the Complainant were in enemical terms and Complainant’s mother Meenakshi was residing along with one of the brothers of the Complainant. Mr. Raganathan two civil cases are pending before the Municipal Court Kollam. From 03/06/2005, the opp.parties issued bills in the name if Meenakshi. The bill amount was remitted by the Complainant. Complainant issued a notice before the 2nd opp.parties and prayed to issue details in the name of the Complainant. The Complanant’s brother Mr. Raganathan is highly influential and leader of Political party is trying to disconnect the electrical connection of Complainant’s premises. Complainant contacted the opp.parties , but opposite parties threatened the Complainant same that they will disconnect the connection. Hence the Complainant filed the complaint for getting relief. The opp.parties filed version contenting interalia that the Complainant is not maintainable and is liable to be dismissed. The Complainant in connection with a Civil disputes. The registered consumer of consumer No. 2022 under electrical section Ayathil is Smt. Meenakshi, Pattathil veedu, Kilikolloor. KSEB authorities issued invoices in the name of Smt. Meenakshi and cannot be issued invoice in the name of the Complainant. Since the ownership is changed to her on 18.02.2006, Smt. Meenakshy submitted a petition before the 2nd opp.party to disconnect the service for 6 months. If registered consumer asks for disconnecting supply the opp.parties are duly bound to comply. If objections are raised by the Complainant and if current charge is paid regularly, the service connection be kept alien. The board authorities acted only as per rules. The service connection can be kept alive without disconnection provided consumer pays current charges regularly. Invoice can be issued to Ravindranathan only after ownership of service connection changed to his name officially. There is no deficiency in service on the part of opp.parties. Based on the conventionthe points that would arise for consideration are: 1. Whether there is any deficiency in service on the part of opp.party. 2. Compensation and cost. The complainant filed Exhibits D1 to P, were marked. Pw1 was examined. For the Opposite Parties Exhibits D1 to D were marked. Para 12 of Version states that 12 (a) The Service Connection can be kept alive without disconnection provided the Consumer pay charges regularly. 12(b) The invoice can be insured in the name of Raveendranadhan, only after the ownership of the service connection changed to his name officially. 12 ( c ) The Kerala State Electricity Board authorities neither disconnected nor threatened the Complainant. The KSEB officials perform their duties in accordance with prevailing rules. The Complaint is to be satisfied with the Compliance of para 12 of the version. Hence the complaint is allowed. The opp.parties are directed to comply with para 12 of the version and to keep alive the service connection with out disconnection, as agreed by the opp.parties. The consumer bill pay current charges regularly, failing which the opp.parties may act in accordance with law. The parties are directed to suffer their costs.
