Smt.K.P.Preethakumari, Member This is a complaint filed under section12 of the consumer protection Act for an order directing the opposite parties to refund Rs.5750/- with interest and Rs.3000/- as compensation with cost. The complainant contended that he had availed gas connection by giving an amount of Rs.5750/- to the 1st opposite party with a stipulation that the deposited amount will be returned back at the time of surrendering the connection. 2and and 3 opposite party as a joint venture supplied the gas. Later on the supply of gas became irregular and that supplied was of substandard\d both in quality and quantity. Because of this the complainant approached the 1st opposite party and surrendered the gas connection and demanded for refund of deposit. But the opposite parties were reluctant to do so. Hence this complaint. Even though the opposite parties were acknowledged the notice issued to them on receipt of the complaint, they were not entered appearance. So the point to be considered is whether there is any deficiency on the part of opposite parties. The Exts/A1 and A2 is the receipt issued b y the opposite party by which the complainant had availed gas connection, which shows that the complainant had given Rs.5750/- for availing gas connection. Ext.A3 is the surrender certificate. The complainant alleged that the opposite parties were shown some deficiency in supplying refilled gas cylinder and in refunding the deposited amount. The opposite parties produced no contra evidence. So we are of the opinion that there was some deficiency on the part of the opposite parties and for which all the opposite parties are jointly and severally liable to compensate the complainant by refunding the deposited amount of Rs.5750/- and the complainant is entitled for the same. In the result, the complaint is allowed in part directing the opposite parties to refund Rs.5750/- (Rupees Five thousand Seven hundred and fifty only) within one month from the date of receipt of this order, failing which the complainant is allowed to execute the order against the opposite parties under the provisions of the consumer protection Act.
