The  basic fact of the case of the complainant Tapati Guha in brief  is that the complainant deposited  a total sum of Rs.10,750/-

with the Ops  company  Sahara Q Shop Unique Products Range Limited under the  scheme with assured  return  of 4.06 times  depending upon  the return on investment  earned  by the society. The said investment was  made with OP No.2 Suman Rakshit against which  the OP No.2 issued one certificate  for Rs.10,750/- on 25.07.2012 bearing receipt no.71010356743  dated 25.07.2012 and certificate  no. 562015430948 dated 25.07.2012. The said  certificate  matured  in July, 2018 and the maturity  value  is Rs.43,645/-. The complainant, accordingly,  requested  the Ops  to make  payment  of the matured  value but the  Ops failed  to pay the matured value. The said company is still doing  the business.  So, the  Ops adopted unfair trade practice  with the  complainant. Hence, the  present case is filed. The cause of action arose  on 25.07.2018 being the date of maturity of the certificate  of investment. The complainant , therefore,  prayed for an award  against the  Ops with a direction to pay Rs.43,645/- as the matured  value  of the certificate,  Rs.50,000/- towards compensation for  unfair trade practice  and mental pain and agony and litigation cost.

The case record  reveals  that notice  was served upon Ops.  As per order no.31 dated 28.08.2023 substituted notice  was issued upon  OP No.2 & 3 through News Paper Publication. As per order no.33 case was decided to be heard ex-parte against  OP No.2&3. Thus the  entire case  is heard ex-parte against all the  Ops.

The complainant  in order to  substantiate  the case adduced evidence  by filing  affidavit in chief  and documentary  evidence.

The complainant  categorically  stated  that she invested  Rs.10,750/- with the Ops company vide certificate no. 562015430948 and receipt no. 71010356743  dated 25.07.2012. After maturity the Ops did not refund  the maturity  value of the said investment  of Rs.43,645/-. The complainant also proved  the original certificate  of investment  with the Sahara Q Shop Unique Products Range Limited through  the authorised  signatory  Suman Rakshit.

The  averment  and allegation  made out in the  complaint stands  entirely   unchallenged  and uncontroverted in as much as  the case is heard ex-parte against all the  Ops. 

Thus after  perusing  the entire pleadings  of the complainant  and assessing  the evidence  on record  the Commission comes to the finding  that the complainant  successfully  proved  the case against  the Ops  ex-parte.

In the result  the complaint case succeeds  ex-parte with cost.

Hence,

                    It is

Ordered

that the complaint case no.CC/11/2020 be and the same is allowed ex-parte with cost of Rs.10,000/- (Rupees Ten thousand). The complainant Tapati Guha do get an award against the Ops jointly and severally for Rs.43,645/- (Rupees forty three thousand six hundred forty five) towards  maturity  value of the investment certificate no. 562015430948 and receipt no. 71010356743, Rs.50,000/- (Rupees fifty thousand) towards compensation for unfair trade practice , mental pain and agony and harassment  and Rs.10,000/- (Rupees ten thousand) towards litigation cost. The Ops jointly and severally  are directed to  pay Rs.1,03,645/- (Rupees one lakh three thousand six hundred forty five) to the complainant  within 30 days from the date of passing the final order failing which  the entire award money shall carry an interest  @ 10p.a from the date of the final order  till the date of its realisation.

All Interim Applications  (I.A) stand disposed of  accordingly.

Let a copy of this final order be supplied to both the parties at free of costs.
