                                                                   ORDER

SRI.K.T.SIDHIQ: PRESIDENT:

              The case of the complainant is that  he availed Neethi gas connection through opposite party No.1 on deposit of Rs.7500/-.  But when he surrender the said connection the  opposite parties did not refund the deposit amount. Hence the complaint praying for an order against opposite parties for the refund of deposited amount with compensation.

2.     Notice issued  to opposite parties served.  But 2^nd opposite party  remained absent  and set exparte. Ist opposite party    filed  version. According to Ist opposite party they collected Rs. 5750/- from the customer at the time of installation of gas connection and remitted Rs. 5650/-  to 2^nd opposite party.  The Ist opposite party acting  only as Commission Agent and received Rs. 100/- as their handling  commission and there is no deficiency in service on their part.

3.  Complainant   examined as PW1 and Ext A1, LPG connection certificate marked.

4.        During evidence, PW1 deposed that  he  deposited Rs 7500/- at the time of  availing  gas connection.  He further stated that the rate of gas cylinder is very excessive  so  he  discontinued  the  connection and also he  surrendered  the  gas cylinder and regulator to  opposite party No.1but they did not issue any certificate to him. 

 5.  The nonrefund of the security deposit even after the surrender of regulator  is a deficiency in service on the part of opposite parties. The Ist   opposite party has not produced any document to prove that they are only commission agent and out of the amount Rs.5,750/- they only received their commissionRs.100/- and the balance is deposited with CONSUMER FED.  Therefore they are liable to refund the amount Rs.5,750/- to the complainant.

         Hence the complaint is allowed and opposite party is directed to refund Rs. 5,750/- to the complainant within one month from the date of receipt of copy of order.  They can recover the said amount of Rs.5,750/- from the CONSUMERFED through appropriate legal proceedings after paying the amount to the complainant.
