Complainant Sri Onkar Nath Singh appeared in person.

Heard complainant in person and perused complaint as well as records.

Perusal of record shows that complainant Sri Onkar Nath Singh has filed Complaint No. 531/2006 Onkar Singh V/s Secretary, Lucknow Development Authority before District Consumer Forum-II, Lucknow which was decided by District Consumer Forum vide order dated 31-10-2012. The order dated 31-10-2012 passed by District Consumer Forum-II, Lucknow in above complaint is extracted below:-

‘’ परिवादी का परिवाद विपक्षी के विरूद्ध स्‍वीकार करते हुए विपक्षी को यह आदेश पारित किया जाता है कि वे परिवादी को उसी प्रकार के क्षेत्रफल का प्‍लॉट गोमतीनगर विस्‍तार क्षेत्र में उसी धनराशि पर दो माह के अंदर आवंटित करें जो परिवादी के द्वारा 1989 में जमा की गयी थी तथा विपक्षी परिवादी को मानसिक कष्‍ट हेतु रू0 10,000/- मय (नौ) प्रतिशत

साधारण वार्षिक ब्‍याज की दर के साथ भी अदा करें। यदि विपक्षी उक्‍त निर्धारित अवधि के अंदर परिवादी को उक्‍त धनराशि अदा नहीं करते हैं तो उक्‍त धनराशि पर उक्‍त तिथि से ता अदायगी तक 12 प्रतिशत वार्षिक ब्‍याज की दर के साथ अदा करना पड़ेगा। इसके अतिरिक्‍त विपक्षी परिवादी को रू0 2000/- (दो हजार) वाद व्‍यय भी अदा करें। ‘’

It is contended by complainant that the opposite parties are avoiding compliance of order passed by District Consumer Forum in complaint and making demands against order passed by District Consumer Forum. Therefore, the complainant has filed present complaint before State Commission.

I have considered the submission made by complainant.

Appeal No. 771/2013 Lucknow Development Authority, through Secretary V/s Onkar Nath Singh was filed against above order dated 31-10-2012 passed by District Consumer Forum and the appeal has been dismissed vide order dated 18-08-2017 passed by this State Commission. As such the order dated 31-10-2012 passed by District Consumer Forum is final and has binding effect on opposite parties. Opposite parties are bound to comply the order passed by District Consumer Forum and in case of disobedience of order passed by District Consumer Forum proper action may be taken against opposite parties of the complaint namely Secretary, Lucknow Development Authority, Lucknow under Section 25 and Section 27 of the Consumer Protection Act by District Consumer Forum on application moved by complainant before it.

In view of above present complaint filed by complainant is dismissed with liberty to complainant to move application under Sections 25 and 27 of the Consumer Protection Act before District Consumer Forum for securing compliance of judgment and order dated 31-10-2012 passed by District Consumer Forum.

Let copy of this order be made available to the parties positively within 15 days as per rules.
