SRI.K.T.SIDHIQ : PRESIDENT

 

       The grievance of the complainant in brief is that the opposite party is not returning him the  amount of `3,50,000/- he invested in his running account with opposite party even after  his repeated demands.

   According to opposite party due to great financial crisis they could not refund the  deposite made by the complainant and they are  trying to dispose a portion of  their landed properties to settle  the debts.

   Complainant filed proof affidavit and Ext,A1 marked.  Ext.A1 passbook issued by opposite party shows that complainant had deposited `3,50,000/- on 3/2/2010.

   During enquiry learned counsel for opposite party submitted that they are ready to return the amount within 2 months .  Hence we pass the following order.

   Complaint is allowed and opposite party is directed to refund `3,50,000/- with interest @9% from 3/2/2010 within 2 months from the date of receipt of copy of this order.  Failing which opposite party shall be liable to pay interest @ 12%  from today till date of repayment.  In the circumstances there is no order as to costs.
