ORDER

 

The complainant has filed a complaint U/s 12 of C.P. Act 1986 against the OPs for a direction to pay Rs.10,14,052/- along with interest at the rate of 18% p.a and such other reliefs as the Forum deems fit to grant.

2.     The brief facts of the case of the complainant are that, he is an agriculturist by profession. Under the National Horticulture Mission Project he entrusted to construct a tank called as "Krishi Honda" measuring about 30000 cum in sy.No.42 of Kunikere Grama Panchayath near Huchchavvanahalli, Yaradakatte Halla in Hiriyur Taluk as per the work order dated 22.02.2007 issued by the Department of Horticulture, Bangalore.  The total estimation of the said project was Rs.20,00,000/- at the rate of Rs.33.33/cum.  Under   the said scheme, the concerned department has to share Rs.10,00,000/- and the remaining Rs.10,00,000/- should be mobilized from the farmers, who was the beneficiary to the said scheme.  It is further submitted that, as per the above said work order, complainant completed the entire work on 28.04.2007 and informed to the concerned department.  Thereafter, the Taluk level Committee of the National Horticulture Mission visited the spot on 18.08.2007 and drawn mahazar about Krishi Honda and submits its report to the OPs for payment of entire bill of the project as per the work order dated 22.02.2007, issued by OP No.3. But, the OPs did not consider the effort made to that order.  Again the complainant made representation to the OPs requesting to release the bill amount on several times but, the OPs did not considered the same.  Thereafter, complainant has given representation to the Government and also to the concerned Ministry to release the bill amount but, the complainant did not succeed to get the bill amount from the OPs.  Then, the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.19695/2009 seeking the relief to direct the OPs to consider and take appropriate action to release the bill amount as per the representation dated 04.07.2009 and the Hon'ble High Court of Karnataka was pleased to allow the said Writ Petition directing the OPs 1 to 3 to consider the request made by the complainant.  In the mean time, the OPs 1 to 3 deposited the bill amount to the account of OP No.5 directing the OP No.5 to issue cheque in favour of the complainant.  But the OP No.5 has issued two cheques bearing No. 280812 for Rs.7,25,541/- dated 08.03.2010 and 280813 for Rs.40,000/- dated 22.03.2010 against Rs.9,96,748/- as per the M.B Book bill submitted to OP No.4.  It is further submitted that, again the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.25972/2012 seeking the direction against the OPs for release of remaining amount and the Hon'ble High Court of Karnataka disposed off the said Writ Petition and directed the OPs to consider the request of the complainant in accordance with law.  But, the OPs did not paid the interest and other damages.  Further, the complainant gave a requisition to the OP No.3 to release the balance bill amount of Rs.2,19,207/- and interest at the rate of 12% p.a on Rs.9,96,748/- from 28.04.2007 to 08.03.2010 of Rs.3,58,829/- and interest at the rate of 12% p.a on Rs.2,19,207/- from 08.03.2010 of Rs.72,338/- with Court Cost, compensation for mental agony and other expenses in all Rs.12,00,375/-.  The copy of the requisition is submitted to OP No.4 and the OP No.4 resolved in the meeting dated 09.07.2014 and recommended the OPs 2 and 3 to consider the requisition of the complainant and to pay the balance amount.  Out of the amount of Rs.12,00,375/-, OPs have paid only the bill balance amount of Rs.2,19,207/- through cheque dated 29.03.2014 by the OP No.5.  It is further submitted that, on the basis of requisition made by the complainant, Grama Panchayat Authorities, Kunikere, recommended the OPs 2 to 4 to consider the request of the complainant and to release the amount of Rs.9,81,168/- towards interest and other expenses.  The OPs have failed to act as per the condition let down in work order dated 22.02.2007, which is a deficiency of service on the part of OPs so, the complainant sustained financial loss and mental agony and etc., and prayed for allow the complaint.

        3.     On service of notice, OPs 1 to 4 appeared through Advocate Sri. Vidyadhara. S and  filed version.  In spite of service of notice, OP No.5 remained absent, hence placed ex-parte.  It is admitted by the OPs 1 to 4 that, under the National Horticulture Mission Project, a work was entrusted to the complainant to construct a tank called as "Krishi Honda" measuring about 30000 cum in sy.No.42 of Yaradakatte Halla in Hiriyur Taluk as per the work order dated 22.02.2007 from Department of Horticulture, Bangalore.  It is true that, the total estimation of the said project was Rs.20,00,000/- at the rate of 33.33/cum and the concerned department has to share Rs.10,00,000/- and remaining Rs.10,00,000/- should be mobilized from the farmers who was the beneficiary of the scheme.  It is denied that, the complainant has completed the entire work on 28.04.2007 and informed to the concerned department and the Taluk level Committee of the National Horticulture Mission visited the spot on 18.08.2007 and drawn mahazar about Krishi Honda and submits its report to the OPs for payment of entire bill of the project as per the work order dated 22.02.2007, issued by OP No.3, which are not within their knowledge.   Again the complainant made representation to the OPs requesting to release the bill amount on several times but, the OPs did not considered the same, which are not within the knowledge of these OPs.  It is true that, the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.19695/2009 seeking the relief to direct the OPs to consider and take appropriate action to release the bill amount as per the representation dated 04.07.2009 and the Hon'ble High Court of Karnataka was pleased to allow the said Writ Petition directing the OPs 1 to 3 to consider the request made by the complainant.  In the mean time, the OPs 1 to 3 deposited the bill amount to the account of OP No.5 directing the OP No.5 to issue cheque in favour of the complainant.  But the OP No.5 has issued two cheques bearing No. 280812 for Rs.7,25,541/- dated 08.03.2010 and 280813 for Rs.40,000/- dated 22.03.2010 against Rs.9,96,748/- as per the M.B. Book bill submitted to OP No.4.  It is true to submit that, again the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.25972/2012 seeking the direction against the OPs for release of remaining amount but, it is false to submit that, the Hon'ble High Court of Karnataka disposed off the said Writ Petition and directed the OPs to consider the request of the complainant in accordance with law.  It is further submitted that, the complainant gave a requisition to the OP No.3 to release the balance bill amount of Rs.2,19,207/- and interest at the rate of 12% p.a on Rs.9,96,748/- from 28.04.2007 to 08.03.2010 of Rs.3,58,829/- and interest at the rate of 12% p.a on Rs.2,19,207/- from 08.03.2010 of Rs.72,338/- with Court Cost, compensation for mental agony and other expenses in all Rs.12,00,375/-.  The copy of the requisition is submitted to OP No.4 and the OP No.4 resolved in the meeting dated 09.07.2014 and recommended the OPs 2 and 3 to consider the requisition of the complainant and to pay the balance amount, which are the self explanatory and without any basis.  It is false to submit that, out of the amount of Rs.12,00,375/-, OPs have paid only the bill balance amount of Rs.2,19,207/- through cheque dated 29.03.2014 by the OP No.5.   It is further submitted that, as per the direction of the Hon'ble High Court of Karnataka, OPs have taken a decision in payment of Rs.2,19,207/- and when there is no specific direction or the clause of interest as not in the agreement, the question of payment of interest does not arise and the complainant cannot seek such reliefs against the Government Authorities.  As per the direction of the Hon'ble High Court of Karnataka in W.P.No.25792/2012, the OPs have settled the balance amount but,  Grama Panchayat Authorities have no locus-standee to recommend the OPs to release the amount of Rs.9,81,168/-.  It is false to submit that, OPs have failed to act as per the condition let down in work order dated 22.02.2007 and there is no deficiency of service on the part of OPs and prayed for dismissal of the complaint with cost.

 4. Complainant himself examined as PW-1 by filing affidavit evidence and Ex.A-1 and Ex.A-2 documents are marked. 

        5. OPs have examined one Sri. P.R. Pandurangappa, the Senior Assistant Director of Horticulture i.e., OP No.3 as DW-1 by filing affidavit evidence and Ex.B-1 to Ex.B-9 documents have been got marked. 

 

        6.     Written Arguments filed and oral arguments heard.

7. Now the Points that arise for our consideration for the decision of the complaint are that:

 

Point No.1:- Whether the complainant proves that, he is an agriculturist by profession and he has completed the work entrusted by the OPs called to construct Krishihonda and claimed the amount from the OPs and the OPs have committed deficiency in making payment to him and thereby complainant has sustained financial loss and mental agony and OPs have committed deficiency of service and entitled for the relief as prayed in the complaint?

        8. Our findings on the above points are as follows:

        Point No.1:- Partly Affirmative.

        Point No.2:- As per the final order.

 

                                        ::REASONS::

9. Point No. 1:- It is not in dispute that, complainant is an agriculturist by profession. He was entrusted to construct a tank called as "Krishi Honda" measuring about 30000 cum in sy.No.42 of Kunikere Grama Panchayath near Huchchavvanahalli, Yaradakatte Halla in Hiriyur Taluk under the National Horticulture Mission Project he as per the work order dated 22.02.2007 issued by the Department of Horticulture, Bangalore, te total estimation of the said project was Rs.20,00,000/- at the rate of Rs.33.33/cum.  The concerned department has to share Rs.10,00,000/- and the remaining Rs.10,00,000/- should be mobilized from the farmers.  As per the above said work order, complainant completed the entire work on 28.04.2007 and informed to the concerned department.  The Taluk level Committee of the National Horticulture Mission visited the spot on 18.08.2007 and drawn mahazar and submits its report to the OPs for payment of entire bill of the project,  but, the OPs failed to consider the effort made to that order.  The complainant made representation to the OPs to release the bill amount on several times and also to the Government but, his request went in vain.  Thereafter, the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.19695/2009 seeking the relief to direct the OPs to consider and take appropriate action to release the bill amount as per the representation dated 04.07.2009 and the Hon'ble High Court of Karnataka was pleased to allow the said Writ Petition directing the OPs 1 to 3 to consider the request made by the complainant.  The OP No.5 has issued two cheques bearing No. 280812 for Rs.7,25,541/- dated 08.03.2010 and 280813 for Rs.40,000/- dated 22.03.2010 against Rs.9,96,748/- as per the M.B Book bill submitted to OP No.4.  Again the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.25972/2012 seeking the direction against the OPs for release of remaining amount and the Hon'ble High Court of Karnataka disposed off the said Writ Petition and directed the OPs to consider the request of the complainant in accordance with law.  But, the OPs did not paid the interest and other damages.  Further, the complainant gave a requisition to the OP No.3 to release the balance bill amount of Rs.2,19,207/- and interest at the rate of 12% p.a on Rs.9,96,748/- from 28.04.2007 to 08.03.2010 of Rs.3,58,829/- and interest at the rate of 12% p.a on Rs.2,19,207/- from 08.03.2010 to 03.12.2012 of Rs.72,338/- and interest at the rate of 12% p.a on Rs.2,19,207/- of Rs.32,885/- with Court Cost, compensation for mental agony and other expenses in all Rs.12,00,375/-.  The copy of the requisition is submitted to OP No.4 and the OP No.4 resolved in the meeting dated 09.07.2014 and recommended the OPs 2 and 3 to consider the requisition of the complainant and to pay the balance amount.  Out of the amount of Rs.12,00,375/-, OPs have paid only the bill balance amount of Rs.2,19,207/- through cheque dated 29.03.2014 by the OP No.5.  On the basis of requisition made by the complainant, Grama Panchayat Authorities, Kunikere, recommended the OPs 2 to 4 to consider the request of the complainant and to release the amount of Rs.9,81,168/- towards interest and other expenses.  The OPs have failed to act as per the condition let down in work order dated 22.02.2007, which is a deficiency of service on the part of OPs.  

 

        10.  In support of his contentions,  complainant has relied on his affidavit evidence in which he has reiterated the contents of complaint.  Complainant has also relied on 6 documents, out of which 2 are originals and 4 are Xerox copies.  Original letter dated 09.06.2015 by the Principal Secretary, Department of Horticulture marked as Ex.A-1, original letter dated 03.12.2012 written by the complainant to OP No.1 requesting to release the amount in respect of construction of Krishihonda marked as Ex.A-2.  Xerox copy of letter dated 22.02.2007 shows the work order with respect to construct Krishihonda at sy.No.42 of  Yaradakatte near Huchchavvanahalli village in Hiriyur taluk.  The Xerox copy of the letter dated 21.03.2012 written by the complainant to OP No.3, in which the complainant has requested to release the remaining balance amount with respect to the said work done by him with interest, court cost etc. 

11.   On the other hand, OP No.1 to 4 argued the matter denying the entire averments made by the complainant.  It is admitted by the OPs 1 to 4 that, under the National Horticulture Mission Project, a work was entrusted to the complainant to construct a tank called as "Krishi Honda" measuring about 30000 cum in sy.No.42 of Yaradakatte Halla in Hiriyur Taluk as per the work order dated 22.02.2007 from Department of Horticulture, Bangalore, the total estimation of the said project was Rs.20,00,000/- at the rate of 33.33/cum and the concerned department has to share Rs.10,00,000/- and remaining Rs.10,00,000/- should be mobilized from the farmers who was the beneficiary of the scheme.  It is true that, the complainant filed Writ Petition before the Hon'ble High Court of Karnataka in W.P. No.19695/2009 seeking the relief to direct the OPs to consider and take appropriate action to release the bill amount as per the representation dated 04.07.2009 and the Hon'ble High Court of Karnataka was pleased to allow the said Writ Petition directing the OPs 1 to 3 to consider the request made by the complainant.  In the mean time, the OPs 1 to 3 deposited the bill amount to the account of OP No.5 but, the OP No.5 has issued two cheques bearing No. 280812 for Rs.7,25,541/- dated 08.03.2010 and 280813 for Rs.40,000/- dated 22.03.2010 against Rs.9,96,748/- as per the M.B. No.25972/2012 seeking the direction against the OPs for release of remaining amount but, it is false to submit that, the Hon'ble High Court of Karnataka disposed off the said Writ Petition and directed the OPs to consider the request of the complainant in accordance with law.  It is argued that, the complainant gave a requisition to the OP No.3 to release the balance bill amount of Rs.2,19,207/- and interest at the rate of 12% p.a on Rs.9,96,748/- from 28.04.2007 to 08.03.2010 of Rs.3,58,829/- and interest at the rate of 12% p.a on Rs.2,19,207/- from 08.03.2010 of Rs.72,338/- with Court Cost, compensation for mental agony and other expenses in all Rs.12,00,375/-.  The copy of the requisition is submitted to OP No.4 and the OP No.4 resolved in the meeting dated 09.07.2014 and recommended the OPs 2 and 3 to consider the requisition of the complainant and to pay the balance amount.  It is further argued that, as per the direction of the Hon'ble High Court of Karnataka, OPs have taken a decision in payment of Rs.2,19,207/- and when there is no specific direction or the clause of interest in the agreement, the question of payment of interest does not arise and the complainant cannot seek such reliefs against the Government Authorities.  As per the direction of the Hon'ble High Court of Karnataka in W.P.No.25792/2012, the OPs have settled the balance amount.  It is denied that, OPs have failed to act as per the condition let down in work order dated 22.02.2007 and there is no deficiency of service on the part of OPs.  

   

12.   In support of their contentions,  OPs have relied on affidavit evidence of one P.R. Pandurangappa, Assistant Director of Horticulture, Hiriyur in which they have reiterated the contents of their version.  OPs have also relied on documents like certified copy of the letter dated 22.02.2007, the work order marked as Ex.B-1, certified copy of the letter dated 22.07.2009 by the office of the Advocate General with regard to the disposal of W.P.No.19695/2009, informing directions to the OPs pertaining to release of the amount claimed by the complainant marked as Ex.B-2, Xerox copy of the order passed in W.P.25792/2012 (GM-RES) wherein, the Hon'ble High Court of Karnataka has passed and order and coming to the conclusion directing the OPs to consider the requisition dated 21.03.2012 made by the complainant as expeditiously as possible within a period of 10 weeks from the date of receipt of copy of the order.  Certified copy of the letter dated 19.03.2010 written by the complainant to President/Secretary, Grama Panchayath, Kunikere  requesting to made payment with regard to the Krishionda marked as Ex.B-3, Certified copy of the letter dated 14.06.2013 by the Chief Secretary, Department of Horticulture to Director, Horticulture Department, Lalbagh, Bangalore marked as Ex.B-4, Certified copy of the permission letter dated 20.01.2014 by the Mission Director, Horticulture marked as Ex,B-5, Certified copy of the letter dated 06.09.2014 by the Mission Director, Horticulture to OP No.1 marked as Ex.B-6, Certified copy of the letter dated 18.11.2014 by the under Secretary, Department of Horticulture to the Director, Horticulture Department, Lalbagh, Bangalore marked as Ex.B-7, Certified copy of the letter dated 02.12.2014 written by the Executive Director, Karnataka State Horticulture Mission Agency (R), Department of Horticulture to the complainant marked as Ex.B-8, Certified copy of the PLI by the people of Huchchavvanahalli marked as Ex.B-9. 

13.   On hearing the rival contentions of both the sides and on careful perusal of the entire records, it clearly goes to show that, complainant is an agriculturist and he was entrusted to construct Krishihonda as per the work order dated 22.02.2007 by the Department of Horticulture in sy. No.42 of Yaradakatte Halla near Huchchavvanahalli in Hiriyur taluk and he has completed the said work as per the work order under National Horticulture Mission Project measuring about 30000 cum.  After completion of the said work the complainant has made a representation claiming payment of bill amount for execution of the work on several times, but the OPs did not considered the same.  Thereafter, complainant filed two Writ Petitions before the Hon'ble High Court of Karnataka bearing No. W.P.No. 19695/2009 and W.P.No.25792/2012 and the Hon'ble High Court disposed of the said writ petitions directing the OPs to consider the request of the complainant.  With regard to the compliance of the W.P.No.19695/2009, OPs have issued two cheques for Rs.7,25,541/- and Rs.40,000/- against Rs.9,96,748/-, i.e., the claim made by the complainant and with regard to the compliance of the W.P.No.25792/2012, the remaining balance amount of Rs.2,19,207/- has been paid. 

14.   Herein, the complainant has filed this complaint to direct the OPs to pay the interest on the above said amount, i.e., Rs.3,58,829/- on Rs.9,96,748/- from 28.04.2007 to 08.03.2010 at the rate of 12% p.a, Rs.72,338/- on Rs.2,19,207/- from 08.03.2010 to 03.12.2012 at the rate of 12% p.a and Rs.32,885/- on Rs.2,19,207/- from 03.12.2012 to 29.03.2014, Rs.5,00,000/- for mental agony with court cost.  The complainant has made a representation dated 21.03.2012 to the OPs for making payment with interest, court cost etc., but, the OPs failed to consider his request.  The Writ Petition filed before the Hon'ble High Court for making payment of the bill amount with interest, court costs etc., was disposed off and the Hon'ble High Court has made an observation in W.P.No.25792/2012 (GM-RES) at Para No.3 that, "Neither the counsel for the petitioner nor the learned Government Advocate is in a position to state as to why the amount for the work done by the petitioner has not been released so far.  In the circumstances, the respondents are directed to consider the petitioner's representation dated 21.03.2012 as expeditiously as possible preferably within a period of 10 weeks from the date of receipt of this order.  In the said representation, the complainant has requested the OPs for making payment of bill amount with interest and court costs etc.  After filing of the Writ Petitions, the OPs have made a payment of the bill amount to the complainant for the construction of the Krishihonda.  Therefore, there is a delay in making payment of the bill amount, so there is a deficiency of service on the part of OPs, which caused the financial loss and mental agony to the complainant.  Because, the complainant has completed the work entrusted by the OPs by investing his huge hard earned money and also by taking loan from the financiers and also from his friends.  Therefore, the complainant is liable to be compensated for the delay in making payment towards the interest on the bill amount issued by the OPs for the construction of Krishihonda in sy.No.42 of Yaradakatte Halla, in Hiriyur taluk.  Therefore, we come to the conclusion that, the complainant is entitled for interest on the bill amount, which he received from the OPs as claimed in the complaint, compensation for mental agony and also cost towards the proceedings.  Accordingly, this Point No.1 is partly held as affirmative to the complainant.

15.   Point No.2:- For the foregoing reasons, we pass the following:

 

ORDER

The complaint filed by the complainant u/Sec. 12 of the C.P. Act, 1986 is hereby partly allowed.  The OPs are jointly and severally directed to pay interest at the rate of 12% p.a from 28.04.2007 to 08.03.2010 on Rs. 9,96,748/- and also interest at the rate of 12% p.a from 08.03.2010 to 03.12.2012 on Rs.2,19,207/-.

 

Further, it is ordered that, the OPs are directed to pay a sum of Rs.2,00,000/- towards mental agony and Rs.5,000/- towards cost of the proceedings. 

 

Further, the OPs are  hereby directed to comply the above order within 60 days from the date of this order.
