ORDER

Complainant not present. Counsel for the opposite party is present and submitted that the complainant has already received Rs. 39,326/- from the opposite party. To this effect the opposite party has produced statement of account of the Bank. On 17/09/2009 sum of Rs. 39,326/- has been debited in to the account of the opposite party in the Bank. Therefore, the submission of the opposite party Advocate that whatever the amount the complainant has paid to the opposite party has been refunded to him. The opposite party has also produced letter written to the complainant dated 20/06/2009. In this letter also, it has been clearly stated that the Managing Committee decided not to accept application for membership to Catholic Club and amount of Rs. 39,326/- is hereby refunded through Cheque dated 17/06/2009. So in view of this the matter requires to be closed. The complainant has no cause of action to file the complaint. The complaint requires to be disposed off since there is no subsisting interest. The issue has been settled in view of the decision of Managing Committee and refund of amount to the complainant. Hence the complaint is dismissed. MEMBER PRESIDENT
