JUDGEMENT

Mr. Purna Chandra Mishra, President.

          Complainant Bhagirathi Kanhar has filed this case alleging deficiency in service on the part of the Opposite Parties for not providing him with the Madhyama Pass Certificate and praying therein for direction to the OPs to provide the certificates to the complainant by correcting the name of his parents and to pay a Rs. 20,000/- towards compensation and a sum of Rs. 10,000/- towards cost of litigation.

  1. Brief fact leading to the case is that the complainant was a student in the Institution of OP No. 2 and passed the Madhyama Certificate Examination held in the month of March 2013. After passing the examination, the OP No.1 provided him with the Certificate in which the name of the father and mother has been mentioned as ‘Kanahar’ instead of “KANHAR”. After receipt of the certificate, he made an application to the OP No. 1 for correction of his name on payment of the appropriate fees but the OP failed to rectify the defect in the certificate and provide with a fresh and correct certificate for which he has filed this case  for the reliefs prayed for in the complaint petition.
  2. After receipt of notice, the Opposite Parties appeared in the case and the OP No. 1 filed the copy of the corrected certificate before this Commission and submitted that they have supplied original pass certificate to the complainant. So, they requested for closure of the case.
  3. On perusal of the record, it is seen that the OP No. 1 has filed the photo copy of the corrected pass certificate. The nature of the defect is only typographical in nature. Since the grievance has been redressed and the complainant is continuously absent, the case is disposed of with the following orders.

                                                                                           ORDER

                The complainant petition is disposed of in the light of the discussion made in the preceding paragraphs as the grievance of the complainant is redressed. Parties to bear their own cost.
