Final Order / Judgement

1.                     The brief history of the case of the complainant is that she was a student of OP.3 and filled up form to appear Annual HSC Examination in the year, 2015 but in the Admit Card she found that Ops have mentioned her name as MEGHASHREE MRGHANJANADAS and her Mother’s name as TOLOTTAMA NAYAK wrongly instead of MEGHASHREE MEGHANJANA DAS and TILOTTAMA NAYAK respectively.  The fact was intimated to the Ops 1 & 3 and they assured to effect correction after the examination is over due to less than a week was left for the said examination.  It is submitted that the complainant appeared AHSC examination vide her Roll No.164DE032 and thereafter on approach, the OP.3 sent necessary papers to OP.1 on 10.3.2015 for necessary correction.  It is further submitted that as per direction of OP.2, necessary documents along with required fees were submitted before OP.1 by OP.3 vide its letter No.40 dt.09.6.2015 but to no action.  The OP.3 also sent reminder vide letter No.20 dt.26.4.2016 to OP.1.  Repeated personal approach of the parents of the complainant to OP.1 also did not yield any result.  The complainant is now in complete fear as she is appearing +2 Sc. Examinations and the certificate may come with wrong entries of names.  Thus alleging deficiency in service on the part of the Ops, she has filed this case praying the Forum to direct the Ops to issue fresh Board Certificate in her favour with necessary correction of names and to pay Rs.1.00 lac towards compensation and costs to the complainant.

2.                     The OP.1 in spite of valid notice neither filed counter nor participated in the proceeding in any manner.  The OP.2 filed its reply through a memo stating that after necessary correction in the certificate of the complainant, the same has been sent to OP.3 for issue to the complainant and prayed to drop this case.

3.                     The OP.3 also filed counter contending that as per admission register and canceled T.C., the School has enrolled the name of the complainant for HSC examination, 2015 through online.  The OP.3 found from the HSC attendance sheet supplied by the BSE, Cuttack that the name of the complainant and her mother’s name incorrect and hence on 02.3.2015 the OP.3 sent necessary documents for correction of names.  It is contended that after obtaining pass certificate of the complainant with wrong entry of names, the school also sent necessary documents and fees and also sent request letter No.40 dt.09.6.2015 to OP.2.  The School also deputed the father of the complainant to OP.1.  After receipt of correct Board Certificate, the same was handed over to the complainant on 27.4.2017.  Thus denying any fault on its part, the OP also prayed to dismiss the case of the complainant.

4.                     The Ops 4 & 5 also in spite of valid notice did not prefer to participate in this proceeding.  Parties have filed certain documents.  Heard from the complainant through her mother and perused the materials available on record.

5.                     In this case the complainant had appeared Annual HSC examination in the year, 2015 conducted by Ops 1 & 2 through her school (OP.3) and it is an admitted fact that her name and her mother’s name was wrongly entered in the Admit Card issued by OP.1.  On approach, the Ops assured necessary correction after the examination is over.  It is seen that on the advice of OP.2, the OP.3 submitted necessary documents in support of correct names along with required fees on 10.3.2015.  As the OP.1 did not take any action, again the OP.3 reminded on 09.06.2015 but no correction was made.

6.                     After filing of present case, the Ops 1 & 2 have issued fresh Board certificate effecting necessary corrections and the complainant has received the said certificate on 27.4.2017.  We do not find any allegation against OP.3 school.  Neither from the complainant nor from Ops 1 & 2 it has been alleged about wrong sending of names by the school.  At the level of Op.1 the mistake occurred for which the complainant and her parents suffered.

7.                     It is the further case of the complainant that she faced trouble for her admission in +2 Sc. Streams and during Form fill up, the same problem arose.  However, the OP.2 issued a certificate that the original Board certificate is under process for correction of some specific particulars and the OP.3 also accordingly requested the Principal, TCST College, Koraput (OP.5) to consider the case of the complainant.  The complainant appeared the said examination during March, 2017 but in the certificate issued by CHSE, her name was wrongly entered whereas her mother’s name found correct.  Hence the complainant through an Addendum prayed to add Ops 4 & 5 as necessary parties to this case.  The Forum allowed her prayer and issued notice to Ops 4 & 5 but they did not prefer to participate in the proceeding.  It is seen that in the merit certificate of CHSE, only the name of the complainant was appearing as MEGHASHREE MRGHANJANADAS instead of MEGHASHREE MEGHANJANA DAS whereas her mother’s name was correctly mentioned.

8.                     In this case the Form fill up for CHSE was done as per certificate issued by OP.2 and the OP No.5 has sent the correct documents.  The OP No.4 was to made necessary corrections but it has made correction to the name of the mother of the complainant leaving behind the name of the complainant.  This is a mistake committed by OP.4.  Hence the OP.4 is to be directed to make necessary correction to the name of the complainant and issue fresh certificate as per the name appeared in the Board certificate and the complainant is to be directed to send necessary documents through OP No.5 to CHSE for the purpose.  The complainant has prayed for compensation of Rs.1.00 lac in this case but in the peculiar circumstances of the case, we are not inclined to grant any compensation in favour of the complainant.

9.                     Hence ordered that the complaint petition is allowed in part and the OP No.4 is directed to effect correction of the name of the complainant in CHSE certificates bearing Roll No.324HA109, Regn. No.HA24S15116 Sl. No.0325924/20171042418 in accordance with the name appeared in the Board certificate issued by OP.1 and issue fresh certificate within 30 days from the date of receipt of documents from the complainant.  Similarly, the complainant is directed to submit all necessary documents before OP.4 through OP.5 for correction of name as soon as possible.  No compensation or cost is awarded in favour of the complainant in the peculiar circumstances of the case.
