This complaint is filed under Sec. 12 of the Consumer Protection Act, 1986 and the matter stood over to this date for consideration. After hearing the matter this Commission passed an order as follows:
2. This is a complaint filed by the complainants against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite parties. The opposite parties entered appearance and filed written version denying the allegations raised by the complainants. Subsequent to that, this case was adjourned for filing proof affidavit of the complainants. Till 08.02.2024 the complainant has not filed affidavit in this case and on that day the counsel for the complainant relinquished the vakalath and this Commission issued notice to the complainant. When the case came up for consideration today, it is noticed that the notice issued to the complainant was served, but there was no representation for the complainants. In spite of giving sufficient opportunities, the complainants failed to file affidavit to further proceed with this complaint. As the complainant failed to adduce any evidence against the opposite parties, we find that there is no piece of evidence against the opposite parties to substantiate the allegations raised by the complainants against the opposite parties. Hence we find that the complainants have miserably failed to prove their case. In view of the above discussions, we find that this is a fit case to be dismissed for want of evidence.
In the result, the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
