EXTRACT OF ORDER

Dt.24.02.2016.            The complaint in brief is that, the complainant is a land line subscriber of OP.s vide his Telephone No.06858-222211. Despite regular payment of telephone dues, the OP.s sent an arrear bill of Rs.3365/- from dt.06.05.11 to 30.04.2015 to the complainant which is excess and illegal. In spite of several approaches, the OP.s did not turned on to the grievance of the complainant. Hence the complainant craves the leave of this forum and claims cost and compensation for his losses and injury. 

            On the other hand the OP.no.2 filed his counter and specified that, enquiring very old long pending dues and giving regard to the hon’ble forum, they exempted the arrear bill of Rs.3365/- claimed upon to the complainant and the telephone in question has also activated and which is working properly in the residence of complainant. Hence he prayed to dispose off the case in the limine.

            Heard the parties and considered the submissions.

            It reveals from the transaction that, the OP.s has exempted the arrear bill of Rs.3365/- and activated the telephone of the complainant which is working perfectly at present. As the root claim of complainant has already been fulfilled by the OP.s, at this stage it would quite abuse of process of law to proceed further with the case. Hence the case disposed off accordingly. No cost.
