                                                                        JUDGEMENT

The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non release of  service  death  benefits of  his late husband  interalia family pension  for which  the complainant  sought for redressal of the grievances raised by the complainant.

On being noticed the O.P  No. 1 & 2 appeared through their learned counsel and filed joint  written version refuting allegation made against them.  The O.P No.1 & 2 taking one and another pleas in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986. The facts which are not specifically admitted may be treated  as denial of the O.P  No. 1 & 2. Hence the O.P No.  1 & 2 prays the forum to dismiss the case against  them  to meet the ends of justice.

 

Heard arguments from the learned counsel for the    O.P  No. 1 & 2 and from the complainant.    Perused the record, documents, written version  filed by the parties. 

This forum  examined the entire material on record  and given  a thoughtful consideration  to the  arguments  advanced  before us by  the  parties touching the points both on the facts  as well as on  law.

                                                                    FINDINGS.

            From the records it reveals that, there is no dispute that the  complainant’s husband  was working  as a Helper under the  O.P. No.1  and while  he was  in service expired  on Dt. 18.2.2011 in District Head Quarter Hospital, Rayagada.(copies of the death certificate of Sri  Sarbeswar Khura  is in the file   which is marked as Annexure-I). Further there is  no dispute   the complainant being  his legal married wife  is a legal heir  and  entitled of retirement  benefits of his late husband  Sarbeswar  Khura(copies of the legal heir certificate  is in the file marked as Annexure-II).

            In the present case the  complainants husband died on Dt. 18.2.2011 but the complainant had  not  received the  service benefits interalia family pension from the O.Ps  till  6.10.2015 so she filed  C.C. case before the forum. Hence this C.C. case.

           
            The  O.Ps in their written version  contended that for settlement of family pension and  other death benefits, it  required  to submit  an affidavit showing final figure of outstanding loan after negotiating with bank  authority for adjustment the death claims  along with required documents. Copies of the letter Dt. 22.6.2015 regarding settlement of family pension attached  herewith  marked as Annexure-3.

            This forum completely agreed with the views taken in the written version  by  the O.Ps  inter alia  filed required documents.

 

So  to meet the  ends of justice    the following order is passed.

                                                            ORDER.

In resultant the complaint petition stands allowed in part against the O.Ps. on contest.

                 The  complainant is  directed to submit  an  affidavit  before the  O.Ps  after negotiating  with the bank authorities for adjustment   against the death claims  within  15 days.  The O.Ps are directed  after receipt of the  affidavit from the complainant  immediately  disposed  off  the above  dispute  of the  complainant  and  balance amount  be  released in favour of the complainant inter alia  to  pay the   family  pension regularly for her livelihood  for which she entitled to  get. There is no order as to cost.

                The above direction  be complied by the parties  with in one month from the date of receipt of this  order.  Copies served on the  parties as per rules  on  free of cost.
