 The brief facts of the case is that complainant being a Government contractor & suppliers namely M/S R. B. Enterprise in the abovenoted address works as per Governement order for livelihood & self-employment. He obtained work order for surfacing of Chengmari to Chengmari Road 10 km under Jalpaiguri Highway Divn issued by Superintending Engineer North Bengal Highway Circle P.W. ( Roads) Directorate and the complainant made RTGS for Rs.2,44,400/- in the name of Indian Oil Corporation for supplying Bitumen. But after getting such money the OP did not supply the said Bitumen for which the complainant suffered loss. That on 15.12.2015 the complainant informed the OP to take suitable action so that he can get the said Bitumen, but no action was taken. Then the complainant sent demand notice by registered post to get the refund amount of Rs.2,44,400/- along with compensation within 7 days from the date of receipt of notice. Thereafter he sent another advocate letter to get the amount from the OP but of no result. Then the complainant filed the instant complaint before this Forum for redressal.

 He filed the complaint annexing a few documents in respect of his claim.

 That on 17.05.2016 the complaint petition heard on the point of admission and after hearing the petition it is admitted and notice sent to the OP for appearance and filing w/v.

 Today is fixed for return of service, appearance with w/v. The A/D in respect of notice sent to the OP received by this Forum earlier.

 Today the complainant filed a verified petition that the dispute between the parties has settled amicably and the complainant is not interested to proceed with the case.

             It appears from the case record that the OP received the notice on 30.05.2016 but none appeared on his behalf on today. In the meantime the complainant today filed the verified petition not to proceed with case and the dispute has been amicably settled. In the verified petition the complainant prayed to withdraw the complaint as lodged against the OP and he has no allegation against the OP.

              After perusing the case record and documents in the record that there is no impediment to dispose the complaint being withdrawn.

ORDER

               Hence it is ordered that the C.C. case 57/2016 be and the same is disposed of being withdrawn as the dispute in between the parties has settled amicably.    

     Let plain copy of this order be made available and be supplied, free of cost, to the parties in person, Ld. Advocate/Agent on record, by hand under proper acknowledgement/be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
