Complainant by filing this complaint has submitted that he made an application under RTI Act 2005 on 21.11.2013 to the S.P.I.O., W. B. P.D., Govt. of W.B. in order to obtain some specific informations of Khardah Police Station and the said RTI Application made by the complainant was duly accompanied with the application of Rs.10/- under sub-section (1) of Section 6 of the RTI Act, 2005, read with Rule 3 of the W.B.R.I. Rules, 2006 but till date the op has not yet given any information to this present complainant at all. But as per provision of RTI Act 2005 the number of time is already expired and fact remains complainant is a consumer under the op and as per provision of C.P. Act, the op did not render proper service and for negligent and deficient manner of service has not entertained the entire application properly and deliberately did not apply the reply for which deficiency in service of the op this complainant prayed for compensation.
On the other hand op by filing this written version submitted that no doubt op received the said application under RTI Act from complainant vide Memo No. 5871-ADM/C/ADM/RTI-48/2012 dated 03.12.2013 of 1 GP (A) W.B. and requested to furnish the information to the Deputy Commissioner of Police to serve the information as sought for.
But op has submitted that op sent all the information to complainant by Dak Challan which was received by one Mumpi Basu (Halder), W/o Sri Subhabrata Basu on 04.01.2014 who is the sister-in-law of the complainant and after receiving the application under RTI Act 2005 op has served the information to the complainant as early as possible and for which there is no negligence or deficiency on the part of the op and for which the present complaint should be dismissed.
Decision with reasons
On proper consideration of the complaint and written version including the argument as advanced by the Ld. Lawyer for the op including the details of the information as supplied, it is found that vide Memo No. 12/R/2014 dated 03.01.2014, Kolkata, Deputy Commissioner of Police (HQ) & SPIO, Barrackpore Commissionerate supplied the entire information as sought for under RTI Act, 2005 by the complainant Shri Debabrata Basu and from the copy of the Dak Challan that one Mumpi Basu (Halder) W/o Subhabrata Basu received the said on 04.01.2014 and in respect of that assertion in the written version that complainant has failed to prove anything. Moreover it is proved that op sent same on 04.01.2014 and practically it was received by the family members of the complainant that is brother’s wife. But even after that the complaint was filed by the complainant on 07.02.2014. So, in view of the above fact and circumstances, we are convinced to hold that complainant got proper service from the op and invariably on 04.01.2014 but that has been suppressed by the complainant.
Truth is that complainant submitted the application on 21.01.2013 and reply ought to have been submitted by the op by 21.12.2013. But in place of that as the same was supplied in the house of the complainant by supplying it to Mumpi Basu W/o Subhabrata Basu and that relationship with complainant has not denied by the op and no evidence has adduced by the Mampi Basu against that. Denying the above assertion of the op and in view of the fact we are convinced to hold that there is no merit in this complaint at this stage when the entire information was received by Mampi Basu W/o Subhabrata Basu that is the brother’s wife of the complainant.
In the result, the complaint fails.
Hence, it is
ORDERED
That the complaint be and the same is dismissed on contest but without any cost.
