1. This is an application U/s 35 of the C.P.Act, 2019.
2. The complainant’s case in brief is that, he is a consumer under TPCODL vide new consumer number 80031070594 & old consumer number 03993829. The electricity meter stood in the name of Deepak Ranjan Sahoo, who was the previous owner of the said building. The present complainant did not know that the electricity meter was defective. When he came to know about this, he went to the office of the OP and enquired about it. The officer of the OP said to him that his department had already changed the meter and advised him to clear the arrear dues. It is alleged by the complainant that, the officer of the OP told him to deposit Rs.7000/- for settlement. Accordingly, he deposited the said amount. But thereafter the OP disconnected the electricity supply to the building of the complainant. Then the complainant met the officer of the OP and showed him the receipt showing payment of Rs.7000/-. Thereafter, they restored the electricity supply. But two months thereafter, the OP again disconnected the electricity supply. The complainant again met the officer of the OP but he did not respond to the complainant. On 05/03/2022, the officer of the OP came to the premises of the complainant and asked him to deposit Rs.10,000/- for settlement of arrear dues but still then, the OP did not settle the arrear dues, which according to the complainant, amounts to deficiency in service. Therefore, the complainant filed this complaint.
3. On the other hand, the OP was set exparte and exparte hearing was taken up on 04/08/2023.
4 Perused the materials on record. The complainant paid Rs.7000/- and Rs.10,000/- to the OP but there is a document in record to show that there was an arrear of Rs.45,368.30 against the consumer account bearing number 03993829. Out of that arrear amount, the complainant has paid only Rs.17,000/-. There is not a single scrap of paper in record to show that the officer of the OP asked the complainant to deposit Rs.7000/- & Rs.10,000/- towards settlement of arrear dues. There is a photocopy of the electricity bill dated 19/01/2023 which shows that, the complainant had to pay Rs.15,207/- to the OP towards electricity dues. Considering the entire facts of the case, I do not find any deficiency in service on the part of the OP. Whatever amount is due to the OP, the complainant has to pay it. As such, the complaint bears no merit. Hence it is ordered.
ORDER
The complaint is hereby dismissed exparte against the OP being devoid of merit.
