Complaint under Section 12 of Consumer Protection Act, 1986.

Present:  Sh. Surender Chauhan, counsel for complainant.

                Sh. Amit Munjal, counsel for Ops.

               

       Today the case was fixed for evidence of complainant, subject to last opportunity.

                No evidence on behalf of complainant is present. Learned counsel for complainant sought an adjournment. On the other hand, ld. counsel for the Ops strongly opposed.  Heard.  From perusal of order-sheet, it reveals that several opportunities including last opportunity have already been granted to the complainant for adducing evidence but complainant faled to adduce evidence.  Vide order dt. 10.05.2019, this commission has passed interim order with the direction to Ops to restore the electricity supply in question of the complainant immediately and not to charge the outstanding bill till further order which means that complainant is taking benefit of undue advantages of interim order by taking no interest in tendering evidence.  Moreover, this complaint is old one as the same pertains to the year 2019 and the same is required to be disposed of expediously.  It also appears that complainant is not interested to pursue the present complaint.  Hence, the present complaint is dismissed for want of prosecution. However, the complainant is at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction, if so desired. The original documents annexed with the complaint, if any, be returned to the complainant by placing on record photocopies thereof. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
