              This appeal has been filed by the  Appellant / Complainant to set aside the order dt.25.11.2022 passed in SR. No.29/2021 and this Commission made the following:-

ORDER

HON’BLE THIRU.  JUSTICE R. SUBBIAH, PRESIDENT.  ( Open Court).

 

This Appeal is filed, seeking to set aside the Order, dated 25.11.2022, passed by the DCDRC, Chengalpattu, in S.R. No.29 of 2021 rejecting the complaint, filed by the appellant herein on the ground “Prima facie case not made out” at the SR Stage.

   2. Heard the appellant.

   3. In our view, rejecting the SR without even assigning any reason there-for is not a proper course.   A cryptic and non-speaking order that has no basis to infer due application of mind to the matter by the Forum concerned, is not only bad in law but also against the principles of natural justice.

          4. In the result, this appeal is allowed and the impugned order dated 25.11.2022 passed by the DCDRC, Kanchipuram @ Chengalpattu in SR No.29 of 2021 is set aside and the matter is remitted back to the District Commission, Chengalpattu with a direction to pass a detailed speaking order in accordance with law.
