Revision Petitioner appeared in person and O.P. through Mr. Shankar Mukhopadhyay, the Ld. Advocate are present.  In course of hearing of the present revision petition a talk of settlement was discussed.  The JDR through Mr. Mukhopadhyay, the Ld. Advocate offers payment of entire amount due under the order of the Forum which is being executed and since affirmed by the Hon’ble National Commission.  Mr. Mukhopadhyay, on behalf of the JDR proposes to pay the sum of Rs. 1,00,000 along with interest @ 15% p.a. from 10.09.2001 till 05.08.2009 as also a sum of Rs. 5,500/- on 05.08.2009 to the Decree Holder.  The authorized representative of the Decree Holder who is present agreed to the said proposal and to accept the said amount to the full and final settlement of the claim and as also the dispute between the parties.  The D.D.O. of this Commission is directed to make the calculation of the interest amount @ 15% p.a. on Rs. 1,00,000 from 10.09.2001 till 05.08.2009 within a period of one week from this day.  At the stage of fixing date for payment of the said amount by the JDR to the Decree Holder before this Commission in terms of the agreement between the parties as recorded hereinabove, the authorized representative of the Decree Holder expressed her objection and wanted to withdraw from the settlement.  On such prayer of authorized representative the Decree Holder was permitted to do so.  At that stage we took up the revision case itself on merit.  Heard the parties.  As one of the two connected matters (being RC/09/38) has already been released by the Forum 24 Pgs (South) with a request to transfer the same to any other Forum and both the matters are connected and both are being conducted by the same person, the execution case is hereby transferred to the nearest Forum C.D.F., Unit – I, Kolkata for disposal in accordance with law.
