                             Digvijay  Vs. RTA

Present:       Sh.RinkuJangra, Advocate for the complainant.

                   Today the case is fixed for consideration on the point of maintainability. Heard. Through this complaint, the complainant has demanded the refund of road tax from the opposite parties on the ground that a vehicle bearing no.HR51BC7536 was got transferred by the complainant at RTO Rohtaki.e. respondent No.1 from RTO Faridabad i.e. respondent no.2 and all the taxes were paid  by him as asked by the respondents.As per the complainant the registration no. of the vehicle is valid from 12.12.2014 to 04.12.2029.  The vehicle in question met with an accident on 13.11.2022 and insurance company treated the vehicle as total loss and requested the respondent no.1 to cancel the RC.  Respondents no.1 cancelled the RC vide letter dated 24.02.2023. Thereafter the complainant has demanded the balance road tax w.e.f. 24.02.2023 to 04.12.2029 from the respondents.

                   We have perused the documents placed on record by the complainant. As per RC placed on record, at the time of purchase of vehicle Smt. Sonia Bhatia R/o 1-D-6, B.P, NIT, Faridabad was the registered owner of the vehicle. Thereafter the complainant purchased the vehicle  inquestion and got transferred the same inhis name in the year 2016. At the time of registration of vehicle the road tax has been deposited by the registered owner of the vehicle. Now the complainant is demanding the remaining road tax w.e.f. 24.02.2023 to 04.12.2029.  In this regard, it is observed that firstly the complainant has not submitted that how much amount of tax was deposited by the previous owner. Moreover, it is a policy matter under Motor Vehicle Act and whether it is refundable or not is not within the jurisdiction of this Commission. As such present complaint is not maintainable before this Commission and the same is hereby dismissed with no order as to costs.

                   Copy of this order be supplied to the complainant free of cost. File be consigned to the record room after due compliance.
