JUDGEMENT

The  crux of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non refund  of  deposited amount  a sum of Rs.10,000/-  towards  non  allotment of the  required registration number  to the  two wheeler   for which  the complainant  sought for redressal of the grievances raised by the complainant. 

Upon  Notice, the O.P   put in their appearance and filed written version.  The O.P   taking one and another pleas in the written version .  .

Heard  the case  and  arguments from  the O.Ps   and from the complainant.    Perused the record, documents, written version  filed by the parties. 

This forum  examined the entire material on record  and given  a thoughtful consideration  to the  arguments  advanced  before us by  the  parties touching the points both on the facts  as well as on  law.

                                                        FINDINGS.

Undissputedly the  complainant  had deposited  Rs.10,000/- (Rupees ten thousand)only  on Dt.07.01.2021   through  on line  towards Earnest money deposit  for  registration  of  two wheeler   to got  the selected   registration  number i.e. OD-18-J-0099 from the  O.P.  bearing   Acknowledgement  No.  FNOR21012941637,  Transaction No. ORY2101074587995,  Receipt No.RO210100506 (copies of the  receipt is available in the file which is marked as Annexure-I).  Undisputedly   and   unfortunately  the  required registration number had not  been  allotted  to the  complainant   by the  O.Ps  and the same  Registration  No. OD-18-J-0099   had  been  allotted to  the other person four wheeler owner  for some  or other plea.

Due to non  allotment of the  required registration number  the complainant  had  contacted to the O.Ps  from  time to time     for refund  of  deposited  amount  but till date the deposited amount   has not  received  from the O.Ps  inspite  of  repeated  contact  to the O.P in person   and   over  phone.  Hence this C.C. case filed  by the complainant   to got  the  deposited fees.

                The  O.P. in their  written version   submitted that  all the transactions has been made on line through   cyber treasury   as such soon after receipt of the clarification   from the  competent authority   it is possible  to take  suitable  steps for refund of the   amount in favour of the complainant(copies of the  correspondence  made with the  Addl.  Transport Commissioner (Tech.) Odisha,Cuttack   vide letter No. 621  dt. 4.5.2021 is  available  in the file which is marked  as Annexure=2).

            To meet the ends of justice  the following order is passed.

                                                ORDER.

            In resultant  the complaint petition is allowed on contest.

            The O.P  is directed to   refund deposited amount a sum of Rs.10,000/-(Rupees  ten thousand)only to the complainant  within   one  month from the date of receipt  of this  order.  Parties are left to bear their own cost.

Serve  the copies of the order to the parties as per rule free of cost.
