The complainant filed the same matter before the office of the Banking Ombudsman, Thiruvananthapuram as No.A/59/64/012B/6. In that complaint, the complainant was the defacto complainant and the opposite parties were also the same. The cause of action for the complaint was also the same. The matter was disposed by the Banking Ombudsman after taking evidence and perusing documents on 21st November, 2006. Again a revision petition was filed by the complainant before the office of the Banking Ombudsman. It was also dismissed on 31.08.2007 after considering the evidence. The complainant also admitted the same facts. So we think that the complaint is barred by resjudicata and it is not maintainable. So the petition is dismissed.
