Both parties are present before us through their respective lawyers and also brief notes of written argument filed by them in accordance with the law.

 

                The case is taken up for hearing. At the outset of hearing ld. Advocate for the O.Ps. no. 1 and 2 submits before us that the insurance company vide its letter dated 21-08-2009 asked the claimant to furnish the necessary particulars within the stipulated period in original but the claimant did not furnish the same within the said period. So they could not settle the claim.

 

                It is further submitted before us that if the papers in original asked for submitted then they will settle the claim immediately. The ld. Advocate for the claimant concedes that they have not furnished the particular papers in original with the insurance company.

 

                Having heard on both sides including the O.P. no. 3  Golden Trust Financial Services we hereby direct the insurance company the New India Insurance Company Ltd. to settle the claim as early as possible on receipt of the particulars from the claimant in original. We also direct the claimant Smt. Sikha Bera to produce the necessary papers in original to the insurance company within one month from the date of order.

 

                The case is thus disposed of accordingly.

                 

                Supply the  copy of the order to the parties, free of costs.
