ORDER ON ADMISSION OF THE COMPLAINT
This complaint is filed by Mr.Shivanna, S/o late Doddegowda, aged 57 years resident of Duddagere Village, Varuna Hobli, Mysuru Taluk to direct the opposite party Nos.1 and 2 the Regional Manager, Indian Overseas Bank, Bangalore and the Branch Manager, Indian Overseas Bank, Megalapura, Mysuru taluk to sanction further loan amount of Rs.5,00,000/- and other reliefs.
The complainant being an owner of land survey No.75/2 situated at Duddagere village measuring 2 acres 8 guntas and he had taken loan of Rs.4,00,000/- from the opposite party No.2 in the year 2014 for cultivation of crops in the said land. The complainant has invested the said amount for drip irrigation and he has repaid the loan amount of Rs.1,75,000/- as on today. It is further case of complainant that in the middle of the year 2018 the crops harvested by him in the land was destroyed by wild pigs. The complainant has asked the opposite party No.2 for grant of sanction of further loan to the tune of Rs.5,00,000/- to fence the above land to protect the crop by sending representations on 15.06.2018, 25.08.2018 and 28.11.2018. When the opposite parties did not respond to his representations, he approached this Forum.
According to the averments of complaint and materials placed before this Forum, the complainant during the period of four years from the date of availment of loan in the year 2014 has not paid the entire amount of the loan but paid to the extent of Rs.1,75,000/-. The said amount might be appropriated towards the interest. The complainant has not repaid the crop loan during the period of four years and without repaying the earlier loan he has approached the opposite parties for sanction of further loan to the extent of Rs.5,00,000/. According to the averments of complaint, the complainant was raising irrigated crops from the year 2014 till 2018 and during that period he would have discharged the entire loan amount. The complainant without discharging the earlier loan has approached the opposite parties for sanction of further loan to the tune of Rs.5,00,000/. We do not find any deficiency in service by the opposite parties for not sanctioning further loan has asked by the complainant since he failed to discharge the earlier loan amount. Therefore, the complaint deserves to be dismissed at this stage. Accordingly, we proceed to pass the following

- Complaint filed by Shivanna, S/o late Doddegowda resident of Duddagere Village is hereby dismissed as not maintainable.
- Return the original documents to the complainant.
- Furnish the copy of order to the complainant at free of costs.
