On the request of complaint file taken up today and complainant made the following statement:-

“Stated that there is some technical flaw in framing the present complaint and I may be permitted to withdraw the present complaint with liberty to file fresh complaint on the same cause of action after removing the technical flaws. Time taken during the pendency of present complaint may kindly be waived off. Original documents placed on this file may kindly be also returned to me”.

          In view of the above statement, the present dismissed as withdrawn, however, the complainant is permitted to file fresh complaint on the same cause of action after removing the defect, if any, in accordance with law, moreover, the time spent before this District Commission shall stand excluded under Section 14 of the Limitation Act in the light of the judgment of the Hon'ble Supreme Court in case titled 'Lakshmi Engineering Works vs PSG Industrial Institute reported in 1995(3) SCC 583'. The original documents be returned to the complainant after placing the Photostat copy of the same in the file. copy of order be supplied to the parties as per rules. File be consigned to record room.
