By G. Yadunadhan, President: The case of the complainant is that he had purchased a churidar material from the opposite party’s shop for Rs.1295/-. After first use itself the colour of the churidar faded and spread with top portion of the churidar. Immediately, complainant intimated this fact to the opposite party. But the opposite party refused to refund the actual cost of the churidar. Hence the complainant is seeking relief against the opposite party to return the actual value of the churidar. After serving notice, opposite party called absent and set exparte. Complainant filed affidavit and he was examined as PW1. Ext. A1 was marked on the side of the complainant. MO1 produced before this Forum. After judicial notice, it was returned to the complainant. From the evidence, affidavit, Ext. A1 and MO1, complainant’s case is proved. In the result petition is allowed and the opposite party is directed to return an amount of Rs.1150/- being the actual value of the Churidar and a compensation of Rs.750/- along with a cost of Rs.200/- to the complainant. Comply the order within one month after receiving the copy of this order. Pronounced in open Court this the 27th day of February 2009.
