ORDER

By ADV. RAVI SUSHA, MEMBER Complainant has filed this complaint for getting the Churidar Piece or its value and compensation and cost. Contents in the complaint is summarized as follows: Complainant purchased a churidar piece worth Rs.370/- from the opp.party’s shop on 3.5.07. On the same day it has been given for stitching. Then the Tailor could found that it is torned due its low quality. On the very next day itself the complainant returned the churidar piece to the opp.party. But he was not ready to accept it or return back the money. Hence the complainant filed this complaint for getting the relief. The complainant was examined in chief as PW.1 and marked Exts.P1 lto P3. The opp.party dared not to turn up. Hence he stands declared exparte. The point to be determined is whether the complainant deserves relief as prayed for. The complainant could prove his case through the complaint, affidavit, deposition in chief and the exhibits marked. The complainant was heard. As the opp.party did not adduce any evidence, the Forum is constrained to accept the evidence adduced by the complainant. Exts.P1 to P3 shows that the opp.party committed deficiency in service towards the complainant. Hence the complainant is entitled to get relief. In the result the complaint is allowed. The opp.party is directed to pay Rs.370/- with 9% interest to the complainant. The opp.party is also directed to pay Rs.1000/- as cost and compensation.
