By G. Yadunadhan, President:<br /> <br /> The case of the complainant is that the complainant entrusted a Panasonic Mobile Phone to the opposite party for repair. Several times complainant approached to the opposite party for taken back the mobile phone; but opposite party refused to return the mobile or repair the same. Hence this case.<br /> <br /> Opposite party after serving notice, called absent and set exparte. <br /> <br /> Complainant filed affidavit. Complainant was examined as PW1. Exts. A1 to A3 were marked on the side of the complainant. From evidence of the complainant and Exts. A1 to A3, complainant’s case is proved.<br /> <br /> In the result petition is allowed. Even though the petitioner is claiming Rs.6000/- for his mobile phone, Ext. A2 clearly shows that the worth of mobile phone is only Rs.3000/-. Therefore, opposite party is directed to pay Rs.3000/- to the complainant as compensation.
