O R D E R
The case of the Complainant in brief is that he is a Consumer under the Opposite Party having his Consumer No. 613680 dated.07-10-2014. On 10-01-2015 he had booked for a domestic gas cylinder through phone call. His booking No. was 501027 dated. 19-01-2015 as reported by the booking office of the Opposite Party but the Opposite Party failed to supply the Gas to him for which he is facing much difficulty. As a result of which he is purchasing daily meals from the hotel for his family members. The Opposite Party is not taking any steps for door delivery which is mandatory as per provision. Being the senior citizen it is not possible on his part to run the office of the Opposite Party for the purpose and to stand on queue for five to six hours to obtain the Gas. Hence he has filed this Complaint for a direction to the Opposite Party to supply the domestic Gas within 7 days of his booking by door delivery and to grant compensation of Rs. 10,000/- towards his mental agony , sufferings and financial loss along with litigation cost to the tune of Rs. 2000/- .
The Opposite Party was set exparte as he was not attending the Forum in spite of getting notice as reveals from the peon book. The Opposite Party is not interested to contest the case.

We have heard the complainant and gone through the Complaint petition. We have also verified the documents filed by the Complainant in support of his case. It is seen from the instruction given in the domestic Gas Consumer card that the cylinder refill shall be delivered and installed at the residence of the Consumer by delivery man of the Opposite party. None delivery of Gas refill in time by the Opposite Party amounts to deficiency in service. Hence, the Complaint filed by the Complainant is allowed exparte against the Opposite Party. The Opposite Party is directed to deliver the Gas cylinder refill to the Complainant within 7 days from the date of his booking henceforth. The Opposite Party is further directed to pay compensation of Rs. 1000/- to the Complainant and also to pay Rs.500/- towards litigation cost to the Complainant within 30 days from the date of receipt of this order.
The C.C is disposed of accordingly. Supply free copy of this order to both the parties.
