The complaint is filed against the deficiency in service of the opposite party.

The complainant purchased a printer from the opposite party on 21.12.2009 for Rs.5,200/-. After three months of purchase, the printer became complaint and the petitioner informed the opposite party. After one month, the opposite party repaired the machine. But the defect was not completely cured and it is not working properly. The complainant had suffered certain losses due to the defect of printer. So this complaint is filed before the Forum.

2. The opposite party is absent and so called ex-parte.

3. The point for consideration is whether there is any deficiency in service on the part of the opposite party, and if so, for what relief the complainant is entitled to?

4. The evidence consists of the oral testimony of PW1 and Exts.P1 & P2 marked on the side of the complainant.

5. The POINT :- The complainant examined as PW1 and marked Exts.P1 and P2. Complainant also produced warranty card of the printer. PW1 filed his affidavit stating that after three months of purchase, the machine showed defects. The opposite party offered 12 months warranty. During the period of warranty, the machine was became defective. Ext.P1 is the bill of the printer and Ext.P2 is the stamp paper for Rs.500/- which was destroyed due to the defect of the machine. Complainant informed the complaint of machine to the opposite party, the opposite party has repaired it, but the repairing is not proper. We find service deficiency in this aspect.

Hence the petition allowed. The opposite party is directed to repair the printer within one month of time or to return the Ext.P1 bill amount, and pay Rs.500/- as the price of the perished document. The opposite party is also directed to pay Rs.1000/- to the complainant as cost of this petition within one month of receipt of a copy of this order failing which the amount shall carry 12% interest per annum from the date of default.
