O R D E R SRI.K.T.SIDHIQ,PRESIDENT The complainant K.Karthiyayani, filed this complaint against Proprietor, Deepam Palm Dish alleging deficiency in service in not rectifying the defects of palm leaf plate making machine. The opposite party filed version denying the allegations of the complainant. 2. During the inquisitorial proceedings in the complaint both parties jointly filed a petition stating that the matter is settled with the parties on certain terms. As per the terms of settlement the opposite party has to extent the warranty and also to provide periodical service to the palm leaf dish plate making machine of the complainant for a period of ONE YEAR and also service the palm leaf dish plate making machine so as to make it in order within 2 weeks from the date of settlement i.e. 21-10-08. 3. The memo filed by the parties are accepted and accordingly we pass the following order. 4. The opposite parties shall rectify the defects of the palm leaf dish plate making machine and make it in perfect working condition within 2 weeks from the date of receipt of copy of order and obtain proper acknowledgement for the same and extend the warranty for the machine for a further period of one year from the date of service and rectification of defects. The opposite party shall also provide periodical services to the machine for a further period of one year from the date of rectification and defects. Failing which the opposite party shall take back the palm leaf dish plate making machine supplied by them and refund the purchase price of Rs.50625/- with interest 12% from the date of complaint.
